The Department proposed making substantive revisions to this guidance document and opened it for public comment at 43 Pa.B. 3421 (June 22, 2013). During the public comment period, the Department received comments from 1,803 commentators. A comment-response document has been prepared and is posted in the eLibrary.

Acceptance of Rulemaking Petition for Study

On February 18, 2014, the Environmental Quality Board (Board) accepted a rulemaking petition for study under 25 Pa. Code Chapter 23 (relating to Environmental Quality Board policy for processing petitions—statement of policy).
The petition, submitted by the University of Pittsburgh School of Law on behalf of the Mountain Watershed Association, requests the amendment of 25 Pa. Code § 93.9v (relating to Drainage List V) to redesignate Stony Run Watershed in Fayette County from Cold Water Fishes to Exceptional Value waters.
Under 25 Pa. Code § 93.4d(a) (relating to processing of petitions, evaluations and assessments to change a designated use), the Department of Environmental Protection (Department) is required to publish a notice of intent to assess candidate waters. The Department's assessment notice for this rulemaking petition will appear in a future issue of the Pennsylvania Bulletin.
The previously-referenced petition is available to the public by contacting the Environmental Quality Board, P. O. In response to Fayette County public comments, DEP did modify the permit to incorporate the leak detection provisions from GP-5.
The well MASTOWSKI 8535H, permit number 051-24383, was originally issued on 9/16/2010, and evidently never went into production.
The Drill & Operate Well permit for Knight 14H was issued on 10/5/2012. None of the Knight wells listed above are showing in the Well Details Report. It appears they may never have gone into production.
The Frankhouser well site is the location of one of the most serious Marcellus Shale violations in Fayette County: holes in the impoundment liner. See Inspection ID 2056000,

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
