Environmental Protection Performance Standards at Oil and Gas Well Sites; Advance Notice of Final Rulemaking; Public Comment Period Extension

By this notice, the public comment period on the Draft Final Rulemaking: Environmental Protection Perform- ance Standards at Oil and Gas Well Sites rulemaking is extended to May 19, 2015. In addition to the comment period extension, the Department of Environmental Protection (Department) will be holding three public hearings on the draft final rulemaking to gather public comments.
The hearings will be held from 6 p.m. to 9 p.m. on the following dates:

Persons wishing to present testimony at a hearing are requested to contact the Department's Policy Office at (717) 783-8727 in advance of the hearing to reserve time to present testimony. Witnesses are requested to submit three written copies of their verbal testimony to the hearing chairperson at the hearing. Organizations are limited to designating one witness to present on their behalf at each hearing.
Testimony is limited to 5 minutes for each witness. Witnesses will be called to testify in the order they registered. If time permits at the hearing, those who did not register in advance will be given the opportunity to testify.
Persons in need of accommodations as provided for in the Americans with Disabilities Act of 1990 should contact the Department at (717) 783-8727 or through the Pennsylvania AT&T Relay Service at (800) 654-5984 (TDD) or (800) 654-5988 (voice users) to discuss how their needs may be accommodated.
The draft final rulemaking is available electronically through the Department's web site at www.dep.state.pa.us (Select ''Oil and Gas Rulemaking'' button).
The Department requests that commentators focus their comments on language that is changed from the proposed rulemaking and that comments be submitted separately for each chapter to aid in comment review and response. The Department particularly seeks comments on the issues of the definition of ''other critical communities'' (§§ 78.1 and 78a.1), noise mitigation (§ 78a.41) and centralized tank storage (§§ 78.57a and 78a.57a).
Written or electronic comments will be accepted through May 19, 2015. Electronic comments may be submitted through the Department's Online Regulatory Comment System at http://www.ahs.dep.pa.gov/RegComments or by e-mail to RegComments@pa.gov. Written comments should be sent to the Department of Environmental Protection Policy Office, 400 Market Street, P. O. Box 2063, Harrisburg, PA 17105-2063. Comments must be received by May 19, 2015. A subject heading of the rulemaking and a return name and address must be included in each letter or transmission. Comments will not be accepted by facsimile or voice mail.

[Republished note from the 2/8/15 edition of this bulletin:] The entries for Coastal Well Pad North above seem to be a complete mess. Why are there two authorizations for the same permit number? Is Springfield Twp correct? This is not likely. PA Oil & Gas Mapping shows no facilities for Burnett in Springfield Twp. Most likely it should be Springhill, where there is another "Coastal" well pad. I am mapping this counted as Springhill Twp without a precise lat/long. Documents for COASTAL SMITH UNIT 2H (permit # 051-24618) were submitted electronically. It is possible the errors for these permits are due to procedural bugs at DEP in handling electronic document submission.
The Site record for site COASTAL WELL PAD CENTRAL ESCGP-2 EXPEDITED, Site ID 790510,

shows Status: "Proposed But Never Materialized". What exactly is going on with all this confusion over Burnett "Coastal" well pad site permits is certainly not very clear.
[Repeat Note from the 11/30/14 issue of this bulletin:] There are several Jackson Farms well sites. DEP does not make it easy to get latitude / longitude for a well pad. For the Jackson Farms Well Site notification above, the Site Record is linked to Inspection ID 2185767 on 07/24/2013; searching the Oil and Gas Compliance Report for Fayette County inspections on 07/24/2013 yields inspections 2185751, Compliance Evaluation, for JACKSON FARMS UNIT 43H; 2185754, Site Restoration, for JACKSON FARMS UNIT 41H; and 2185759, Site Restoration, for JACKSON FARMS UNIT 42H. So in spite of the fact there is no match for Inspection ID, I'm assuming JACKSON FARMS UNIT 41H gives the correct location. The records for this well indicate Menallen Twp, so I am mapping it that way. The eFACTS site record indicates Redstone Twp. DEP site record municipalities have been known to be incorrect in several instances. All these data inconsistencies are extremely frustrating.
Normally an air quality permit with a number such as 26-00588A for Shamrock above would replace a permit with number 26-00588. So why are both permits being extended? This is a bit odd. Perhaps Laurel Mountain Midstream is having a problem getting the new equipment working. On April 7, 2015, a team from Earthworks captured FLIR video of Shamrock and report that it was absolutely "spewing" VOC emissions. (Stay tuned for notice of availability of this video.)

This is not in Stewart Twp, or even close. It's not clear what is correct here as far as location is concerned. There is a well in Steward Twp called JAY E LEONARD UNIT 628 1 OG WELL in Stewart Twp that might be the right location; it is located here:

Due to all these uncertainties, I'm not mapping this project.
From the drawings of the well pad in the NOI (Notice of Intent) for the Liggett Well Pad it appears they are planning 10 wells at this pad.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. eNOTICE records are likely to list the same permit multiple times, as that permit moves through the DEP process.

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
