Fayette County Marcellus Shale Permits 5/13/13 - 5/26/13

Note: Starting with this issue I will make an effort to mark those entries that are located in Environmental Justice Areas. DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. It is evidently the intention of DEP's Office of Surface Mining to enter into contract # OSM 26(7605)102.1 for remediation of a still burning underground mine fire known as the Phillips Mine Fire. The surface property is approximately adjacent to the surface property on which the Marcellus well site Kikta 1H-4H is located. (E.g. Kikta 1H, location 39.947036,-79.743575:

). What the implications are of an underground mine fire next to a Marcellus well site is not clear. All four of the Kikta wells have been drilled, fracked, and are in production. The surface owner's entry agreement with DEP also mentions the following identifiers:

I can find absolutely no information at all about this case on-line.

Notes:

Companies applying to DEP for an Erosion & Sedimentation permit to build a pipeline are required to send a Municipal Notification both to the municipality (typically Township) and to the County. (Note that this is for all municipalities, not just those that do their own zoning.) The original notification for the Skirpan to North 24" project sent to Redstone Township dated 1/21/2010 includes Brownsville Twp among the municipalities; the Skirpan well site which is evidently the western end of this pipeline is located in Brownsville Twp. Leaving Brownsville Twp out of the list of municipalities in the eFACTS site record for this permit is evidently an error on the part of DEP. I'm not aware of who at DEP is supposed to be informed of errors in eFACTS (of which alert readers of this bulletin will recall I've listed several!) 24" is pretty large for a gathering line. One would hope that with such a large diameter pipeline, DEP would take the trouble to at least get the muncipality list correct. If they can't even get this right, what else about this application hasn't been properly evaluated? This site was originally permitted under Authorization ID 882700, <http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleAuth.aspx?AuthID=882700>. The previous Notification authorization for this site, Authorization ID 950027, <http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleAuth.aspx?AuthID=950027>, was denied on 11/29/2012. Permit denials are not listed in the PA Bulletin, and the DEP denies very few permits. One wonders what the story is here.

The location shown above for the well BAER UNIT 6H is taken from the location given for an earlier permit for this well, which was withdrawn. The surface property owner asserted that the earlier permit, 051-24450, placed the Baer well site well bores too close to a water source (i.e. less than 500 feet), and DEP agreed. The current Baer permits are also the subject of a protest by the surface land owner, who asserts that they are within 500 feet of a spring which Chevron destroyed in constructing the well pad. At this writing this dispute is ongoing, and bears watching. This location was widely covered in the news, see e.g. "Bags of cremated remains ordered removed from disputed Fayette gas land". (Placing cremated ashes of ancestors at all property entrances is a religious requirement under the religion of the surface owner's wife; this was not done as a "maneuver" to block drilling, as some of the news articles about this site have implied.) The well pad has already been constructed, but the disputes concerning proximity to springs have so far kept Chevron from constructing any wells on it.
