A page on this issue will appear at Fayette Marcellus Watch shortly. There are many troubling issues in the current draft, including disowning DEP's role as an advocate for health, and purging the authority of Article 1 Section 27.

Mountain Gathering is a subsidiary of XTO, which is a subsidiary of Exxon Mobil. The notification is pursuant to Act 14, which requires companies seeking certain kinds of permits to notify every county and municipality in which the project occurs. This notification is quite remarkable. It is very unusual to see an application for a compressor station also list nearby wells. The need to aggregate wells together with the pipeline-connected compressor station has been very contentious in both public comments / responses and Environmental Hearing Board appeals.

DEP's instructions for the Notice of Intent for an E&S permit ESCGP-1 (since superseded by ESCGP-2) states: "An OG-57 waiver request must be submitted for any well site which lies within 100 feet of a blue line stream on a USGS Quad map or within 100 feet of any wetland greater than one acre in size."

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township.
