Final Technical Guidance—New Guidance

 DEP ID: 800-5000-001. Title: Addressing Spills and Releases at Oil & Gas Well Sites or Access Roads. Description: This policy is developed to facilitate a consistent and uniform general response by those working in and for the oil and gas industry to respond to spills and releases at oil and gas well sites or access roads regulated by the Department. The policy provides clear guidance on how to address spills and releases, including when spills and releases must be reported to the Department and the standards for remediation and restoration after spills and releases occur. The proposed policy was published in the Pennsylvania Bulletin for a 30-day public comment period at 42 Pa.B. 2101 (April 14, 2012) under the document number 550-5000-001. The Department received 67 unique comments from 12 commentators, revised the proposed policy accordingly, and has prepared a comment response document.

notice: The U.S. Environmental Protection Agency, Region III (EPA) plans to issue an Underground Injection Control (UIC) permit to PGE under the authority of the Federal UIC regulations at 40 C.F.R. Parts 124, 144, 146, and 147. The permit is necessary to construct and operate one class II-D brine disposal injection well.

description: PGE submitted an application to EPA in February, 2013 requesting to convert a gas production well, the Marjorie C. Yanity 1025, to a privately owned brine disposal injection well. The well would be used for the injection of fluids produced in association with PGE's oil and gas production operations. The proposed injection well is located in Grant Township, Indiana County, Pennsylvania. EPA has developed a draft permit Draft Permit (PDF) (14pp, 139.32MB); and Statement of Basis (PDF) (6pp, 125.71KB) which allows PGE to convert a gas production well into a brine disposal well and to inject produced fluids from oil and gas operations into the Huntersville Chert Formation at a depth of 7532 feet.

opportunity for comment: EPA requests public comment on its findings that the proposed injection activity in the draft permit is unlikely to pose a risk to underground sources of drinking water. Please mail public comments on the draft UIC permit to the EPA address listed above to the attention of Stephen Platt, or e-mail comments to platt.steve@epa.gov, by October 28, 2013. The Estimated Location shown for SR-4007 WATER INTAKE is inferred from the Fayette County Planning Commission agenda for September, 2013, at the approximate closest point between Rowes Run Road and Redstone Creek. (eFACTS does not give an eMapPA link.) Sara Rosiek, Director of Planning, Zoning, and Community Development for Fayette County, informs that this facility will require a Special Exception for Public / Private Works from the Fayette County Zoning Hearing Board.

Underground Injection Control (UIC) wells in Pennsylvania are regulated directly by the EPA. Such wells have been scientifically shown to be capable of causing earthquakes in some cases. As far as I know there are no such wells in Fayette County -- the permit application above for Indiana County is the closest to Fayette County I know of.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.

Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.
