 DEP ID: 260-0500-001. Title: Policy for Coordinating Immediate Responses and Final Remediation of Spills and Releases. Description: This policy summarizes how the Department oversees immediate responses and final remediation of spills and releases of regulated substances onto soils. The purpose of the policy is to facilitate the consistent investigation of and the response to spills and to coordinate immediate response needs with final remediation endpoints.

Draft Technical Guidance—Substantive Revision

 DEP ID: 550-3000-001. Title: Standards and Guidelines for Identifying, Tracking, and Resolving Oil and Gas Violations. Description: This policy provides direction to Department staff in determining enforcement actions the Department will pursue to resolve violations and achieve compliance with applicable laws and regulations related to conventional and unconventional oil and gas development. The policy also provides advisory information to the regulated industry. Once finalized, this document will replace the previous policy ''Compliance Monitoring of Oil and Gas Wells and Related Facilities and Activities'' that was issued in 2005. Revisions are necessary to reflect changes to the organizational structure of the agency and to update the policies and procedures to reflect current oil and gas development activities in Pennsylvania.

26-00588A: Laurel Mountain Midstream, LLC (1550 Coraopolis Heights Road, Suite 140, Moon Township, PA 15108) plan approval minor modification effective September 18, 2014, to revise the original leak detection and repair condition and other conditions impacted by the U.S. Supreme Court's June 23, 2014, ruling in Utility Air Regulatory Group v. Notes:

Without having reviewed the documents I can't be certain, but it looks as though the PA Bulletin notice for Shamrock Compressor Station above is extreme bad news. The Leak Detection & Repair (LDAR) provision referred to sounds like the permit modification won in response to public comment at the hearing in Fayette Countty in New Salem. This modification required Laurel Mountain Midstream (LMM) to use FLIR photography to check for leaks, consistent with DEP's GP-5 general permit for compressor stations. The US Supreme Court ruling referred to is I believe the case on whether EPA has the authority to regulate CO2 emissions. The court ruled that if EPA has the authority to regulate a facility for other forms of air pollution, it can regulate CO2 also. But EPA does not have authority to regulate CO2 "only". (And likewise for greenhouse gasses (GHG) generally.) That raised a difficult question: If a pollution source is a minor source for all pollutants except GHG, but is over the major source threshold for GHG, can it still be classified as a "Major Source"? This is the issue it looks like LMM is attempting to exploit. We will have to explore (quickly!) whether this permit modification is appealable. Since the LDAR provision exists in GP-5, the idea that it rests on DEP's authority to regulate GHG can certainly be challenged. Note there is no public comment listed on this permit. The permit was issued on 9/18/2014. That means the deadline for filing an appeal is 10/18/2014.

The exact latitude and longitude for the Columbia Gas LINE 7906 REPLACEMENT project above were derived from the eMapPA link embedded in the authorization record on eFACTS. A single "pinpoint location" is obviously not consistent with the large number of townships listed in the Site record. It's not clear what that exact latitude and longitude are marking -- perhaps the "center" of the project. For this reason, I am not showing this exact latitude/longitude on the map.

The original permit for the HOEHN 1048 TO CRABLE 8 PIPELINE ESCGP-EXPEDITED was issued on 05/11/2012 (Authorization ID 922202).

Baer 6H shows in DEP records as "Proposed But Never Materialized". This well site is one of the few cases on record where a resisting surface landowner litigated and defeated a drilling company. One assumes that the Notification above for BAER WELL CONNECT ESCGP-EXPEDITED is a notification that this is not going to ever be constructed. DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. eNOTICE records are likely to list the same permit multiple times, as that permit moves through the DEP process.

Marcellus Shale waste disposal injection wells in Pennsylvania are regulated directly by EPA, not DEP. Notice of any new permit applications will appear at the above web address.  I'm not aware of any subscription service to be notified of such applications. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.

Disclaimers:

Does not currently include water supply permits. Does not include landfill permits even though many such are for Marcellus Shale waste. (It is not possible at this time to distinguish which landfill permits are for Marcellus Shale waste and which are not without doing File Review for each permit.)

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
