Final Technical Guidance-Substantive Revision

Source Determinations for the Oil and Gas Industry. Description: The
Department announces the availability of its final technical guidance
for performing single source determinations for the oil and gas
industries. This guidance will assist the Department's air program
permitting staff in making single source determinations for the oil and
gas industries.
There are significant natural gas exploration and extraction activities
occurring in the Commonwealth within the Marcellus Shale formation and
other formations. Single source determinations arise when stationary air
contamination sources belong to the same industrial grouping, are
located on one or more contiguous or adjacent properties and are under
the control of the same person. These determinations will be made in
this Commonwealth on a fact specific and case by case basis, applying
the applicable regulatory criteria. This final guidance applies to case
by case analyses conducted by the Department's air program permitting
staff when determining whether stationary sources should be considered a
single source for permitting requirements applicable to programs
including the Prevention of Significant Deterioration, Nonattainment New
Source Review and the Title V permitting programs. Copies of this

Notes:
DEP Technical Guidance Document 270-0810-006, whose publication was
announced in the PA Bulletin notice above, is mysteriously unavailable
where it is supposed to be on DEP's web site. This document describes
the policy DEP personnel reviewing air quality permits should use to
assess whether air emissions from a compressor station should be
aggregated together with pipeline-connected wells. This is the subject
of vigorous controversy, including strong public comments against the
proposed revision to 270-0810-006, and litigation in two different cases
(Shamrock Compressor Station and Houston Gas Plant) before the
Environmental Hearing Board.
The violations noted above for the SPRINGHILL CS TO BEZJAK PIPELINE
ESGPX-EXPEDITED have occurred (if I'm not mistaken) on the Headley
property. This site has received considerable national attention,
including from the New York Times and NRDC (Natural Resources Defense
Council).
The well Hoehn 7H (authorization 942810), as measured by Google Earth
using DEP's published latitude and longitude, is less than 2000 feet
from the Monongahela River. Act 13 extended the zone of presumed
liability for contamination of a water supply from 1000 feet in the
former Oil and Gas Act to 2500 feet. (This part of Act 13 was *not*
struck down by the recent court action.) There are many communities that
get their water from the Monongahela River. That means that (in my
opinion) there is a clear case that Chevron would have presumed
liability for any contamination of the Mongahela river from this well
site. I am not aware of any public comment opportunity to remind either
Chevron or DEP about this.
The Environmental Impact Statement (EIS) being prepared by FERC for the
Texas Eastern TEAM 2014 Project is the first EIS related to Marcellus
Shale for Fayette County since this bulletin has been published. FERC is
*explicitly* seeking public comment. This is an important opportunity
for us to comment on issues related to compressor stations that DEP has
refused to address. For instance: DEP has refused, despite public
comment, to require a *dispersion study* which would translate
"Potential To Emit" (PTE) numbers for emissions in tons per year into
probabilities of acute-effect exposure to unsafe dosages of chemicals.
FERC, however, has been known to require a dispersion study. (The
document awarding National Fuel Gas a federal certificate of convenience
for a project in Washington County required them to do a dispersion
study for the Buffalo Compressor Station in Buffalo Township, Washington
County.) This public comment period is an opportunity to insist that
acute-effect exposure to toxic substance disease be included in the EIS.

same document recently distributed by Commissioner Angela Zimmerlink to
her Marcellus Shale Task Force E-mail list. Thanks to Commissioner
Zimmerlink for distributing this document.]
eFACTS links the facility MAWC 7020 5H (authorization 943703) to the
site record "FAYETTE COUNTY PROJECT ESCGP-EXPEDITED" which shows these
municipalities: Dunbar Twp, North Union Twp, Springfield Twp, Stewart
Twp. Something is clearly wrong here. I suspect someone at DEP got the
wrong site record. I've seen multiple townships for a pipeline project,
but for a well site permit this makes no sense.
When the previous issue of this bulletin was published, a link was not
available for the PIOGA petition for the PUC to reconsider the part of
its order in the Peregrine case vacating Administrative Judge Susan D.
Colwell's Recommended Decision. The PUC has *granted* reconsideration,
but this appears to be pro forma to avoid a deadline, and doesn't
indicate how the PUC will rule when considering the petition on its
