Availability of the Final Modifications to the General Plan Approval
and/or General Operating Permit for Natural Gas Compression and/or
Processing Facilities (BAQ-GPA/GP-5)

The Department of Environmental Protection (Department) finalized
modifications to the General Plan Approval and/or Operating Permit
(BAQ-GPA/GP-5 or General Permit) for Natural Gas Compression and/or
Processing Facilities. The General Permit modifications include the
following:
1. Removal of the 100,000-ton per year greenhouse gas emissions
applicability threshold for the use of GP-5.
2. Clarifying that the Applicability/Scope of GP-5 applies to all
types of natural gas-fired compressors.
3. Addition of an annual compliance certification requirement
signed by a Responsible Official.
4. Clarifying that EPA Method 323 is the appropriate test method to
determine formaldehyde emissions.
5. Deletion of references to 40 CFR Part 63, Subpart HH (relating
to National emission standards for hazardous air pollutants from oil
and natural gas production facilities).
6. Other minor clarifying modifications.
The notice of availability of the proposed GP-5 modifications was
published at 44 Pa.B. 7243 (November 15, 2014). The Department
received written comments on the proposed amendments from ten
commentators during the 45-day comment period, as required under 25
Pa. Code § 127.612 (relating to public notice and review period). A
comment and response document has been prepared, which summarizes
the Department's response to the comments.
BAQ-GPA/GP-5 applies to the construction, modification and/or
operation of any natural gas compression and/or a gas processing
facility. The modified General Permit is now available for use by
qualifying applicants. Applicants may seek authorization to use GP-5
by submitting the General Permit application to the appropriate
Department regional office. Applicants must receive the Department's
written approval prior to constructing and/or operating sources
under this General Permit.

DEP ID: 820-4000-001. Title: Standards and Guidelines for
Identifying, Tracking, and Resolving Oil and Gas Violations.
Description: This policy provides direction to District Oil and Gas
Operations staff in following a consistent approach in identifying,
tracking and resolving violations. It also provides standards and
guidelines for initiating, documenting and resolving water supply
investigation requests. It outlines the enforcement actions the
Department may pursue to achieve compliance with applicable laws and
regulations related to conventional and unconventional oil and gas
development. The policy also provides advisory information to the
regulated industry. The finalization of this document replaces the
previous policies ''Compliance Monitoring of Oil and Gas Wells and
Related Facilities and Activities'' (550-3000-001) and ''Enforcement
Actions by the Department's Oil and Gas Management Program''
(550-4000-001). Revisions were necessary to reflect changes to the
organizational structure of the Department and to update the
policies and procedures to reflect current oil and gas development
activities in this Commonwealth. Notice of availability of the draft
guidance was published at 44 Pa.B. 6290 (October 4, 2014) as a
substantive revision to document 550-3000-001 for a 30-day comment
period that was extended at 44 Pa.B. 6853 (October 25, 2014) for an
additional 15 days to November 18, 2014. The final guidance has been
renumbered to reflect the reorganization of the Office of Oil and
Gas Management.

Notes:
The current permit for Prah Compressor Station
was issued on 2/12/2010, meaning that it presumably expires on
2/12/2015. It appears there has never been a Special Exception as a
Public/Private Works for this facility from the Fayette County
Zoning Hearing Board (a situation which was brought to the attention
of the county by Fayette Marcellus Watch). According to Sara Rosiek,
Director of Planning, Zoning, and Community Development for Fayette
County, DEP is holding approval of the current permit application
due to the zoning issue. It is unlikely that the ZHB will be able to
act on this matter before the expiration date of the Prah DEP
permit. What will happen at that point remains to be seen.
The well pad relationship for the
Sanfilippo wells is confusing. There appear to be
two Sanfilippo well pads
located in close proximity; according to
PA Oil and
Gas Mapping, Sanfilippo 1H, 2H, and 8H are on the Southwest
pad, and 3H, 4H, 5H, 6H, and 7H are on the northeast pad. However
O&G Mapping seems to have the wrong well pad ID for 8H, and
shows two pads at the northeast location, which is probably also
incorrect. Why there are two well pads so close together is a
mystery; it would seem this would cause Chevron a lot more expense.
Of the 8 Sanfilippo wells, only 5H shows as a conservation well.
However, Oil & Gas Mapping does not yet have the 6 Drill &
Operate Well Permit Drill Deeper permits. There is a possibility
after these appear the conservation well status of some of the
others could change. 7H and 8H do have the current permits linked,
and those are not applications for conservation well status.

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

). There are supposed to be enhanced public participation
requirements for permits in environmental justice areas, but news of
this actually ever happening is scarce. In Fayette County, the
entirety of Springhill, Nicholson, German, and Georges Townships are
environmental justice areas, as well as a large part of Dunbar

eNOTICE records are likely to list the same permit multiple times,
as that permit moves through the DEP process.
Oil & Gas Wells designated with a site a number and the letter H

injection wells in Pennsylvania are regulated directly by EPA, not
DEP. Notice of any new permit applications will appear at the
above web address. I'm not aware of any subscription service
to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County
(yet ...) but we need to monitor this page for future
applications.

latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
