Availability of Climate Change Action Plan Update

The Pennsylvania Climate Change Act (71 P. S. §§ 1361.1—1361.8)
requires the Department of Environmental Protection (Department), in
consultation with the Climate Change Advisory Committee, to submit
to the Governor a Climate Change Action Plan (Plan) that is revised
every 3 years. This document is the second update to the original
Plan issued by the Department in December 2009.
The Plan is required to:
• Identify greenhouse gas (GHG) emission and sequestration trends
and baselines in this Commonwealth.
• Evaluate cost-effective strategies for reducing or offsetting GHG
emissions from various sectors in this Commonwealth.
• Identify costs, benefits and cobenefits of GHG reduction
strategies recommended by the Plan, including the impact on the
capability of meeting future energy demand within this Commonwealth.
• Identify areas of agreement and disagreement among committee
members about the Plan.
• Recommend to the General Assembly legislative changes necessary
to implement the Plan.
The Department is accepting comments on the draft Plan update
through March 30, 2016.
Comments submitted by facsimile will not be accepted. Comments,
including comments submitted by e-mail, must include the
originator's name and address. Commentators are encouraged to submit
comments using the Department's online eComment tool at
www.ahs.dep.pa.gov/eComment. Written comments may be submitted to
the Department of Environmental Protection, Policy Office, Rachel

The NYMEX Henry Hub average annual price of natural gas for 2015
was $2.664.
There were 785 unconventional gas wells spud in 2015 and 1,372
unconventional gas wells spud in 2014.
Section 2302(c) of 58 Pa.C.S. (relating to unconventional gas well
fee) requires an annual adjustment if more wells were spud in the
current year than the prior calendar year. The 2015 United States
Bureau of Labor Statistics Consumer Price Index of all Urban
Consumers (CPI-U) in PA, DE, NJ and MD reflects an increase. In 2015
there were less wells spud than in 2014 and the CPI-U reflects a
downward trend of -0.2. There will be no increase in the base price
of the impact fee for calendar year 2015.

26-00535B: Dynegy Fayette II, LLC (100 Energy Drive, Masontown, PA
15461) Notice is hereby given in accordance with 25 Pa. Code
§§ 127.44—127.46 that the Department of Environmental Protection
(''Department'') intends to issue Air Quality Plan Approval:
PA-26-00535B to Dynegy Fayette II, LLC (''Dynegy'') to allow
physical and operational changes to both combustion gas turbines
(''CGT'') at Fayette Energy Center located in Masontown Borough,
Fayette County.
Dynegy proposes to replace components of the turbine section and
additionally change combustion control logic to increase combustion
air flow for each CGT. Maximum heat input capacity of each CGT will
increase as a result of this project along with an increase in
electric generating capacity and efficiency. Additional definition
is also provided for startup, shutdown and turbine tuning operating
scenarios currently excluded from the hourly emission limits.
Runback and malfunction event operating scenarios are also defined
and added to this exclusion. This project does not result in a
significant emission increase and does not trigger nonattainment new
source review (''NNSR'') or prevention of significant deterioration
(''PSD'') requirements.
This authorization is subject to Federal New Source Performance
Standards (''NSPS'') under 40 CFR Part 60 Subpart KKKK—Standards of
Performance for Stationary Combustion Turbines. As a result, this
facility will no longer be subject to NSPS Subparts Da and GG which
are currently incorporated into Dynegy's Title V Operating Permit
(''TVOP''). Applicable NOx and SO2 emission limitations under
Subpart KKKK are superseded by prior Lowest Achievable Emission Rate
and Best Available Control Technology determinations for this
facility. Plan approval conditions will include performance testing
and associated reporting requirements, as well as Runback and
malfunction event and additional definition of operating modes
excluded from the hourly emission limits. Facility-wide
recordkeeping, reporting, and monitoring requirement's already
included in Dynegy's TVOP will encompass the modified sources.
Emission limitations for each CGT, with operation of duct burners,
will remain unchanged on a short term concentration and mass basis,
and 12-month rolling total basis. Combined 12-month rolling limits
for the CGTs with duct burners remain not to exceed 286.7 tons of
NOx, 562.3 tons of CO, 87.3 tons of VOC, 126.7 tons of SOx, 309.8
tons of PM10, 9.6 tons of formaldehyde, and 166 tons of ammonia
during any consecutive 12-month period. Once compliance with the
Plan Approval is demonstrated, the applicant will subsequently
submit either a TVOP renewal application or a TVOP administrative
amendment application in accordance with 25 Pa. Code Chapter 127
Subchapters F and G.
A person may oppose the proposed plan approval by filing a written
protest with the Department through Alan Binder, Pennsylvania
Department of Environmental Protection, 400 Waterfront Drive,
Pittsburgh, PA 15222. Additional written comments may also be
submitted. Each protest or set of written comments must contain the
name, address and telephone number of the person submitting the
comments, identification of the proposed Plan Approval
(PA-26-00535B) and a concise statement of the objections to the plan
approval issuance and the relevant facts upon which the objections
are based.
A public hearing may be held, if the Department, in its discretion,
decides that such a hearing is warranted based on the information
received. All persons submitting comments or requesting a hearing
will be notified of the decision to hold a hearing in writing or by
publication in the newspaper and the Pennsylvania Bulletin, or by
telephone, where the Department determines such notification by
telephone is sufficient.
Dynegy's Plan Approval application, the Department's Air Quality
Review Memorandum, and the Proposed Air Quality Plan Approval for
this project are available for review by any interested party at the
Pennsylvania Department of Environmental Protection, Southwest
Regional Office, 400 Waterfront Drive, Pittsburgh, PA 15222. To
request a review of the Dynegy Plan Approval Application, to receive
an electronic copy of the Department's Air Quality Review
Memorandum, or to receive an electronic copy of the Department's
proposed air Quality Plan Approval for this project, a person may

Kikta Well Site:
On 02/01/16 at approximately 1330 hours I conducted a
site restoration inspection in response to an NOT submittal by
Chevron Appalachia LLC. The Act 9 sign was in place and all
required documents were present at the site.
The site was well vegetated and met the requirements of uniform
70% growth. All temporary BMPs had been removed from the site and
there was no unnecessary equipment present at the site. The NOT is
approved.
NOT means "Notice of Termination"?? Apparently the Notification
application above for the KIKTA UNIT WELL SITES indicates Chevron is
"done with" the Erosion & Sedimentation permit for this site.
Readers are reminded that an application of type
Notification may mean the "end" of work, not "new" work.
The EDWARD L. ROSINSKI, ET UX site was
originally permitted to Phillips Exploration Inc. on
12/21/2010.
Facility Search for this location shows "Proposed But Never
Materialized".

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site.
The DEP has been known to list a municipality incorrectly.
