 Executive Order 1996-1 requires all agencies under the jurisdiction of the Governor to submit for publication an agenda of regulations under development or consideration. Subsequent agendas will be published on the first Saturdays in February and July.

 The agendas are compiled to provide members of the regulated community advanced notice of regulatory activity. It is the intention of the Administration that these agendas will serve to increase public participation in the regulatory process.

 Agency contacts should be contacted for more information regarding the regulation and the procedure for submitting comments.

 This Agenda represents the Administration's present intentions regarding future regulations. The nature and complexity of an individual regulation obviously will determine whether and when any particular regulation listed (as well as any considered subsequent to publication of this Agenda) is published.

 The public is invited and encouraged to provide feedback regarding the Regulatory Agenda, including but not limited to feedback regarding its usefulness, the nature and extent of readers' usage of the Agenda, the frequency with which users consult or refer to the Agenda and any other general suggestions which the public may have regarding the Agenda. Additional RACT Requirements for Major Sources of NOx and VOCs

This rulemaking amends Chapter 129 to establish additional reasonably available control technology (RACT) requirements for major stationary sources of nitrogen oxides and volatile organic compound (VOC) emissions to fulfill 8-hour ozone RACT requirements for all major sources not covered by Federal Control Techniques Guidelines (CTG) recommendations. Upon promulgation, the final-form regulation will be submitted to the EPA for approval as a revision to the State Implementation Plan. (Air Pollution Control Act)

INSPECTION_COMMENT: On or about January 21, 2016, the Department received an ESCGP-1 major revision submittal for ESX10-051-0045.  During the review process it was discovered that ESX10-051-0045 had already expired.  Given that the permit was not terminated before expiration, the site is currently in violation of 25 Pa. Code §102.7(a).  At the time the violation was identified, the operator was attempting to make a major revision to the currently expired ESCGP-1.  The operator should consider submitting an application for a NEW ESCGP-2.  The operator will still be required to maintain the Erosion and Sedimentation Control Plan in accordance with ESX10-051-0045 until the approval of the new ESCGP-2 is conferred by the Department.

At only one engine of 203 HP this makes it one of the tiniest compressor stations in Fayette County.

That the comment in Inspection Report ID 2451281for STEVENS UNIT 1H above can read "the site is currently in violation of 25 Pa. Code §102.7(a)" and there still be no violation issued simply defies understanding. In this bulletin we have seen all kinds of anomalies written up in inspection comments with no violation issued, but none quite so blatant as the notation that a site is "in violation of 25 PA Code" and the result is "No Violations Noted".

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.
