Proposed General Plan Approval and/or General Operating Permit for

The Department of Environmental Protection (Department) proposes to
issue a revised General Plan Approval and/or Operating Permit
(BAQ-GPA/GP-5 or General Permit) for Natural Gas Production and/or
Processing Facilities that establishes emission limitations and other
applicable Federal and State requirements including Best Available
Technology requirements.
The revised General Permit, BAQ-GPA/GP-5, which is authorized under
section 6.1(f) of the Air Pollution Control Act (35 P.S. ? 4006.1(f))
and 25 Pa.Code Chapter 127, Subchapter H (relating to general plan
approvals and operating permits), will apply to the construction,
operation and modification of air contamination sources at new and
existing natural gas production and/or processing facilities. The
applicability and scope of the revised General Permit BAQ-GPA/GP-5 has
been expanded to cover air contamination sources including, but not
limited to the following: wellheads and valve assemblies, natural
gas-fired spark ignition internal combustion engines, natural gas-fired
simple cycle turbines, centrifugal compressors, condensate tanks,
distillation towers, glycol dehydrators, reboilers, natural gas
fractionation units, vapor recovery systems, storage vessels, flares,
valves, piping, flanges and transport loading arms.
On August 23, 2011, the United States Environmental Protection Agency
(EPA) proposed, for public review and comment, rules concerning the
''Oil and Natural Gas Sector: New Source Performance Standards and
National Emission Standards for Hazardous Air Pollutants Reviews'' (76
FR 52738). The proposed revised General Permit includes proposed
provisions of the Federal rules, which will automatically be adopted
and incorporated by reference in the Pennsylvania Code once finalized
by the EPA. It is anticipated that the Federal rules applicable to the
oil and natural gas sector will be finalized in April 2012. This
General Permit will not be issued prior to the publication of EPA's
final rules.
The proposed substantive revisions to the GP-5 include conditions that
prescribe applicability, emission limitations, compliance,
notification, monitoring, recordkeeping, reporting and administrative
requirements. This General Permit does not authorize the construction,
modification or operation of sources subject to the Prevention of
Significant Deterioration and nonattainment new source review
requirements specified in 25 Pa.Code Chapter 127, Subchapters D and E
(relating to prevention of significant deterioration of air quality;
and new source review). In addition, this General Permit does not cover
spark ignition internal combustion engines or simple cycle turbines
that are used as ''peak shaving engine generators.''

Implementation of Unconventional Gas Well Impact Fee Act, Act 13 of

On February 14, 2012, Governor Corbett signed House Bill 1950 into law
as Act 13 of 2012 or the Unconventional Gas Well Impact Fee Act (Act
13), which amends Title 58 (Oil and Gas) of the Pennsylvania
Consolidated Statutes, providing for an impact fee, Oil and Gas Act
amendments and standards for local ordinances. The Act allows counties
to pass ordinances to impose an impact fee on unconventional gas well
producers and alternatively allows municipalities to adopt resolutions
compelling the imposition of fees related to these wells.
The Act specifically requires the Pennsylvania Public Utility
Commission (Commission) to administer the collection and disbursement
of the impact fee. Also, if requested by a municipality, the Commission
is required by Section 3305(a) of the Act to review a proposed local
ordinance and issue an advisory opinion on whether the ordinance
violates the Municipalities Planning Code or Act 13. In addition, the
Commission is required by Section 3305(b) of the Act to issue an order
when a request for review is filed by an owner or operator of an oil or
gas operation or a person residing within the geographic boundaries of
a local government who is aggrieved by the enactment or enforcement of
a local ordinance.
The Commission has established Docket Number M-2012-2288561 for all
Secretarial Letters and Implementation Orders regarding Act 13.
Counties and municipalities should also use Docket Number
M-2012-2288561 to file notices of election to implement an impact fee
and/or municipal resolutions to compel the imposition of an impact fee
pursuant to Section 2302 of the Act. Further, producers should use this
Docket Number to file reports pursuant to Section 2312 of the Act.
Requests from municipalities for advisory opinions regarding proposed
local ordinances pursuant to Section 3305(a) of the Act should be filed
with no docket number. The Commission will assign a separate docket
number for each such request. Along with these requests, municipalities
should provide a copy of the proposed ordinance, as well as information
and an explanation of their view as to whether it violates the
Municipalities Planning Code or Act 13.
On and after April 16, 2012, the Commission will accept requests for
review filed by producers or residents regarding local ordinances and
assign a separate docket number for each such request. Further
instructions governing such filings will be provided in subsequent
Commission communications.

Notes:
Most compressor stations in Pennsylvania receive Air Quality permits
under an expedited process known as a General Permit -- for compressor
stations this permit is called GP-5. Approval by the DEP of a specific
instance of GP-5 IS NOT SUBJECT TO PUBLIC COMMENT. However, when GP-5
*itself* is revised, those revisions are subject to public comment. The
public comment period for GP-5 published above is likely to be our only
opportunity FOR YEARS to comment on the permitting rules for most
compressor stations. If I am reading the applicability section of the
draft correctly, the "new" GP-5 will apply to even more compressor
stations than the current one. The only exemption I can see for
eligibility under the new GP-5 is for compressor stations whose air
emissions are so large that they qualify under EPA rules as a Major
Source. (The only compressor stations in Fayette County currently
classified as Major Source are Texas Eastern Uniontown and Dominion
Transmission Summit -- though Shamrock has applications pending as
Major Source.)

Several counties have already filed their intent to impose an impact
fee, but Fayette County has not yet done so.

The Ronco Industrial Wastewater Treatment Facility in Masontown is the
only facility in this area licensed to treat flowback and produced
water from Marcellus Shale drilling. It is not clear why such data as
the radium listings are missing from the data published above. This
facility is the subject of an appeal before the Environmental Hearing
Board; the docket number in that case is 2009134, and documents in that
case are available here:

Act 13 of 2012 establishes a new limit of 3000 feet within which a
driller has presumed liability for contaminating a water source. The
well HOEHN UNIT 7H OG WELL, authorization 916060 above, is
significantly less than 3000 feet from the Monongahela River. (I show
the approximate distance as 1700 feet.) Does this mean that granting of
this permit establishes presumed liability for contamination of the
Monongahela river with Chevron? Is this well site within the
Monongahela River flood plain? Act 13 contains new restrictions on
wells located in a floodplain:
(f) Floodplains.--
(1) No well site may be prepared or well drilled within any
floodplain if the well site will have:
(i) a pit or impoundment containing drilling cuttings, flowback
water, produced water or hazardous materials, chemicals or wastes
within the floodplain; or
(ii) a tank containing hazardous materials, chemicals,
condensate, wastes, flowback or produced water within the floodway.
(2) A well site shall not be eligible for a floodplain
restriction waiver if the well site will have a tank containing
condensate, flowback or produced water within the flood fringe unless
all the tanks have adequate floodproofing in accordance with the
National Flood Insurance Program standards and accepted engineering
practices.
(3) The department may waive restrictions upon submission of a
plan that shall identify the additional measures, facilities or
practices to be employed during well site construction, drilling and
operations. The waiver, if granted, shall impose permit conditions
necessary to protect the waters of this Commonwealth.
It is not clear what recourse citizens have to comment on this issue.

Kurutz Unit 10H appears to be one of Fayette County's worst wells for
continuing violations.
DEP is going from bad to worse in maintaining the eFACTS records for
Chico Unit 1H. This well is located in Springhill Twp, close to the
Springhill #2 compressor station. First DEP duplicated site records for
Chico Unit 1H, erroneously listing the second record in Springfield
Twp. Evidently someone at DEP discovered the duplication, but in the
attempt to fix the problem they deleted the correct site record and
kept the wrong one. To make matters worse, the authorization above (ID
917720) points to the *missing* (but correct) site record! The eFACTS
database is evidently not designed properly if it allows this kind of
deletion.

eNOTICE records are likely to list the same permit multiple times, as
that permit moves through the DEP process.
Oil & Gas Wells designated with a site a number and the letter H
typically designate horizontal wells.
