Environmental Justice Advisory Board Special Meeting

[Saturday, April 5, 2014]
The Environmental Justice Advisory Board (Board) will hold a special
meeting on Tuesday, May 6, 2014, from 6 p.m. to 8 p.m. in the Chester
City Hall Community Room, 1 Fourth Street, Chester, PA 19013.
The Board is holding this public listening session to provide
interested stakeholders an opportunity to give public comment on
concerns and suggestions regarding environmental justice issues. The
Board will provide recommendations to the Department of Environmental
Protection (Department) based on information gathered from the
listening session.
Persons interested in providing oral comment at the public listening
session should register by contacting Holly Cairns, Director, DEP
Office of Environmental Advocate, (717) 783-9731, hcairns@pa.gov, no
later than 5 p.m. on Friday, May 2, 2014. Organizations are requested
to designate one spokesperson to provide comment. Comments are limited
to 5 minutes. Persons providing oral comment should provide three
written copies of their comments at the listening session.
Those unable to attend the listening session that would like to
provide written comment can e-mail comments to
RA-EPPubliccomments@pa.gov or submit them to Environmental Justice
Advisory Board, c/o DEP, 400 Market Street, 16th Floor, Harrisburg, PA
17101. Written comments will be accepted until 8 p.m. on Tuesday, May
6, 2014.
Questions and topics raised from the community listening session will
be addressed in a comment/response document that will be available at a
later date on the Department's web site at www.dep.state.pa.us (DEP

INSPECTION_COMMENT: On 4/1/2014, I conducted an inspection of the Atlas
Resources DEIDRICH # 3 OG WELL well in Jefferson Township, Fayette
County. The inspection was the result of Atlas reporting a brine
spill of unknown quantity, some of which went off containment at
this site. Atlas reported the spill to me on 3/31/14.
On 4/3/2014, Atlas submitted an Initial Spill/Incident Notification to
the Department.
According to reports from Atlas, the spill was thought to be the
result of a leaking 3" valve and a hole in the 100 barrel tank. The
brine leaked out of the tank and caused a puddle of brine inside
secondary containment. The containment dike had a drain pipe with
a cap. Recent precipitation events caused the fluid in the dike
to overflow it's banks. A small amount of brine left the site
onto the access road and killed a small amount of vegetation below the
road. The area of dead vegetation was approximately 2 foot by 2
foot. The leaking tank will be replaced by a poly tank and the operator
has cleaned up the affected soil and performed testing to ensure all

regulated directly by EPA, not DEP. Notice of any new permit
applications will appear at the above web address. I'm not aware
of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.

(It is not possible at this time to distinguish which landfill permits
are for Marcellus Shale waste and which are not without doing File
Review for each permit.)
Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit and
using published latitude and longitude for the well. It is possible I
may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The
DEP has been known to list a municipality incorrectly.
