Notice of Veto; House Bill 1100, Printer's No. 3259
March 27, 2020
To the Honorable House of Representatives
of the Commonwealth of Pennsylvania
Pursuant to Article IV, Section 15 of the Pennsylvania
Constitution, I am returning herewith, without my approval, House
Bill 1100, Printer's Number 3259.
These are unprecedented times as the people of this Commonwealth
face the daily realities of the COVID-19 pandemic: realities that
require the necessary mitigation measures instituted to protect the
life and health of all Pennsylvanians, including the closure of all
''non-life sustaining'' businesses, the closure of schools, and
social distancing. We are all making these difficult sacrifices as
our lives, society and economy halt to a near-standstill. I am proud
of the way Pennsylvanians have responded to this crisis. We, in
government, must follow their lead.
Rather than enacting this bill, which gives a significant tax
credit for energy and fertilizer manufacturing projects, we need to
work together in a bipartisan manner to promote job creation and to
enact financial stimulus packages for the benefit of Pennsylvanians
who are hurting as they struggle with the substantial economic
fallout of COVID-19.
The petrochemical and natural gas industries play an important part
in Pennsylvania's energy-efficient and energy-sustainable future. I
am fully supportive of this type of economic development within the
Commonwealth. However, we have a duty, as custodians of taxpayer
funds, to ensure that taxpayer-funded economic development
incentives, like the proposed tax credit, are a responsible use of
the Commonwealth's limited resources. Further, the required capital
investment from companies and required job creation thresholds that
must be met in order to receive the credits must adequately align
with the level of economic development incentive. Furthermore, this
bill does not guarantee the creation of jobs paying prevailing
wages, wages Pennsylvania's workforce deserves when a project
receives this level of financial commitment from the Commonwealth.
Although the bill requires payment of prevailing wages for facility
construction, the requirement is illusory because the critical
enforcement and investigative tools provided under the Pennsylvania
Prevailing Wage Act are absent from this bill.
I could be supportive of awarding an incentive such as this, but
only after a thorough analysis of a proposed project and the
inclusion of appropriate enforcement mechanisms to ensure that
workers constructing these types of facilities rightfully are paid
prevailing wages. While I am always supportive of business
development here in the Commonwealth, I am also focused on making
sure that we are investing taxpayer money in, projects that protect
our workforce, support our communities and provide the financial
stimulus needed to stabilize and grow our economy during this time
of crisis.
For the reasons set forth above, I must withhold my signature from
House Bill 1100, Printer's Number 3259.

Extension of National Pollutant Discharge Elimination System General
Permit for Discharges from Hydrostatic Testing of Tanks and
Pipelines (PAG-10)

Under The Clean Streams Law (35 P.S. §§ 691.1691.1001) and
sections 1905-A, 1917-A and 1920-A of The Administrative Code of
1929 (71 P.S. §§ 510-5, 510-17 and 510-20), the Department of
Environmental Protection (Department), by this notice, extends for
12 months the availability of the current National Pollutant
Discharge Elimination System (NPDES) General Permit for Discharges
from Hydrostatic Testing of Tanks and Pipelines (PAG-10).
The existing PAG-10 General Permit in effect at this time will
expire on July 10, 2020. Persons that are currently operating under
the PAG-10 General Permit may continue to operate until July 10,
2021. The Department is extending the availability of this permit to
adequately complete preparation of the renewal of the PAG-10 General
Permit. During the period of administrative extension, no new
coverage under the PAG-10 General Permit may be authorized by the
Department.

Residual Waste General Permit WMGR123; Proposed Modifications and
Renewal

The Department of Environmental Protection (Department) is
proposing modifications to, and renewal of, Residual Waste General
Permit WMGR123, under the Solid Waste Management Act (35 P.S.
§§ 6018.1016018.1003); the Municipal Waste Planning, Recycling and
Waste Reduction Act (53 P.S. §§ 4000.1014000.1904). This base
general permit authorizes the processing, transfer and beneficial
use of oil and gas liquid waste to develop or hydraulically fracture
an oil or gas well.
The proposed modifications include the following:
Defining the terms ''processing,'' ''transfer'' and ''storage''
as the terms pertain to the general permit.
Changing the application requirement for coverage under WMGR123
from a registration to a determination of applicability. This change
is consistent with the application requirements for most general
permits issued by the Department's Bureau of Waste Management and
provides the general public with an opportunity to comment on
WMGR123 operations that may be sited in their municipality. The
change from a registration to a determination of applicability does
not impact the information that is required to be submitted to the
Department as part of an application for coverage under WMGR123, or
impact operations that have been previously permitted based upon a
registration application.
Clarifying the sampling and analysis requirements based upon the
type of WMGR123 operation (facilities actively processing oil and
gas liquid waste prior to beneficial use as opposed to facilities
that are only utilizing temporary storage without additional
processing before beneficial use).
Revising sampling and analysis requirements to allow WMGR123
operations that are processing oil and gas liquid waste to
demonstrate, with a statistical demonstration, that a reduced
sampling frequency and reduced parameter list are justified.
Revising conditions pertaining to frequency of inspections and
cessation of operations for WMGR123 operations located on permitted
oil and gas well pads.
Revising conditions pertaining to processing or transfer of oil
and gas liquid waste to include ''storage'' for clarity.
Reorganizing the general permit for clarity and ease of use, such
as utilizing the standard format seen in other general permits for
consistency purposes and incorporating standard permit conditions,
like a requirement for the submission of an annual operating report.

Fayette Marcellus Watch was deeply
involved in Chevron's WMGR123 permit application for the Dogbone
Centralized Water Facility in Luzerne Twp. The instructions for
applying for a WMGR123 permit are apparently not being modified.
They require submission of a Form X, Radiation Protection Action
Plan. The Form X submitted by Chevron for the Dogbone Centralized

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this
actually ever happening is scarce. In Fayette County, the entirety
of Redstone, Springhill, Nicholson, and German Townships are
environmental justice areas, as well as a large part of Dunbar

to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County

latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site.
The DEP has been known to list a municipality incorrectly.
