Draft Technical Guidance Document: New Guidance
DEP ID: 800-4000-002. Title: Civil Penalty Assessment Informal Hearing
Procedure for the Office of Oil and Gas Management.
Description: Section 3256 of the 2012 Oil and Gas Act (act) (58 Pa.C.S.
§ 3256) provides that the Department may assess a civil penalty for
violations of the act or a regulation, order or permit issued by the
Department under the act, after a hearing. Section 3256 of the act
further provides that a person charged with a penalty must, within 30
days of notification, pay the penalty or file an appeal of the
assessment with the Environmental Hearing Board. This document outlines
the procedure for the conduct of the informal civil penalty assessment
hearings.
Written Comments: Interested persons may submit written comments on
this Draft Technical Guidance Document. Comments must be received by
May 27, 2014. Comments submitted by facsimile will not be accepted.
Comments, including comments submitted by electronic mail must include

We submit for your consideration the following comments on the
proposed rulemaking published in the December 14, 2013 Pennsylvania
Bulletin. Our comments are based on criteria in Section 5.2 of the
Regulatory Review Act (RRA) (71 P. S. § 745.5b). Section 5.1(a) of the
RRA (71 P. S. § 745.5a(a)) directs the Environmental Quality Board
(EQB) to respond to all comments received from us or any other source.

26-00599A: PPL Renewable Energy, LLC (Two North Ninth Street,
Allentown, PA 18101) Notice is hereby given in accordance with 25
Pa. Code §§ 127.44—127.46 that the Department of Environmental
Protection (DEP) intends to issue Air Quality Plan Approval 26-00599A
to allow the installation and initial temporary operation of a landfill
gas to energy plant at the Chestnut Valley Landfill located in German
Township, Fayette County. Sources include landfill gas treatment
system, two (2) landfill gas-fired reciprocating internal combustion
engines, and associated two (2) electric generators.
Potential emissions are not expected to exceed 43.0 tons of nitrogen
oxides (NOx), 150.8 tons of carbon monoxide (CO), 8.8 tons of volatile
organic compounds (VOC), 18.8 tons of formaldehyde (HCHO), 20.8 tons of
total hazardous air pollutants (HAPs), and 18,154 tons of carbon
dioxide equivalents (CO2e) per year. Best available technology (BAT)
for the proposed landfill gas-fired engines is ultra-lean burn
combustion technology and good combustion practices including the use
of air/fuel ratio controllers and proper maintenance and operation. The
authorization is subject to State regulations including 25 Pa. Code
§§ 123.1, 123.2, 123.31 and 123.41. Federal New Source Performance
Standards (NSPS) including 40 CFR Part 60 Subpart JJJJ for spark
ignition internal combustion engines and Federal National Emission
Standards for Hazardous Air Pollutants (NESHAPS) including 40 CFR Part
63 Subpart ZZZZ for reciprocating internal combustion engines will
apply to the proposed engines. Plan Approval has been conditioned to
ensure compliance with all applicable rules. This includes testing,
work practice, monitoring, recordkeeping, and reporting conditions.
Once compliance with the Plan Approval is demonstrated, the applicant
will subsequently apply for a Title V Operating Permit in accordance
with 25 Pa. Code Subchapter G.
A person may oppose the proposed plan approval by filing a written
protest with the Department through Alexander Sandy, Pennsylvania
Department of Environmental Protection, 400 Waterfront Drive,
Pittsburgh, PA, 15222. Additional written comments may also be
submitted. Each protest or set of written comments must contain the
name, address and telephone number of the person submitting the
comments, identification of the proposed Plan Approval (PA-26-00599A)
and concise statements regarding the relevancy of the information or
objections to issuance of the Plan Approval.
All comments must be received prior to the close of business 30 days
after the date of this publication.
A public hearing may be held, if the Department, in its discretion,
decides that such a hearing is warranted based on the information
received. All persons submitting comments or requesting a hearing will
be notified of the decision to hold a hearing in writing or by
publication in the newspaper and the Pennsylvania Bulletin, or by
telephone, where the Department determines such notification by
telephone is sufficient.

INSPECTION_COMMENT: On 4/23/2014 Dominion Trans Inc., self reported a
spill of an unknown amount of brine water at their UW#107 storage well
site off Skyline Drive in South Union Township, Fayette County.
The spill was found by the well tender on 4/23/14, when they noticed
dead vegetation around the containment dike drain valve and a trail
leading down slope from there. No waterways were
affected.The Department inspected the site on 4/25/2014.
Weavertown envrionmental and Dominion work crews had been on site since
the spill was discovered. Weavertown was conducting the soil
testing and Dominion's crews were doing the contaminated soil
removal. The spill is thought to have been caused by a leaking
vlave on the dike drain. The brine seeped out of the leaking
valve and traveled down slope for approximately 70 yards across a field
and into the woods. Crews were removing contaminated soil from
the spill's furthest point, back up to the leaky valve area. Work
removing the contaminated soil was expected to be concluded by the end
of today.

Notes:
The listing above for authorization 1022281 is
shown as SHEPERD UNIT 4H. However, the permit number listed, 051-24511,
is for the well SHEPERD UNIT 6H. If the correct "Farm name" is supposed
to be SHEPERD UNIT 4H, the correct permit number should be 051-24509.
Something "serious" seems to have happened at this well site.
Apparently, none of the wells has gone into production. There are
anecdotal reports of an
underground explosion
at this site. Shepard 6H has a violation for "Failure to report
defective, insufficient, or improperly cemented casing w/in 24 hrs or
submit plan to correct w/in 30 days" (Inspection ID 2206094, <

In the wake of the Bobtown explosion, one would sure like to know what
happened at the Sheperd well site. This authorization record is clear
evidence that at least one well at this site has
FAILED PERMANENTLY AND COMPLETELY.
There is something EXTREMELY ODD about Laurel
Mountain Midstream applying for an extension of
both permits 26-00588 and
26-00588A. Normally one would consider that 26-00588A has
replaced 26-00588. It is not clear
what is going on here.
The "GP5" permit for the Sanfilippo Well Sites
above is not the same type of permit as a GP-5 for a compressor
station. General Permits are numbered separately by different bureaus
within DEP. So the Bureau of Air Quality's GP-5 is not the same thing as
the Office of Water Management's GP5.
BURNWORTH WEST UNIT 1H was issued a "Drill
& Operate Well Permit Inactive Status" on 5/3/2012, and appears to
be the only well on this pad. It apparently never went into production.

defines an environmental justice area as "any census tract where 20
percent or more individuals live in poverty, and/or 30 percent or more
of the population is minority". (See:

). There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this actually
ever happening is scarce. In Fayette County, the entirety of
Springhill, Nicholson, German, and Georges Townships are environmental
justice areas, as well as a large part of Dunbar Township. DEP's policy
document on public participation guidelines for environmental justice

Marcellus Shale waste disposal
injection wells in Pennsylvania are
regulated directly by EPA, not DEP. Notice of any new permit
applications will appear at the above web address. I'm not aware
of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.

This compilation from the above sources was done by hand using copy and
paste and may omit relevant permits.
Does not currently include water supply permits. Does not include
landfill permits even though many such are for Marcellus Shale waste.
(It is not possible at this time to distinguish which landfill permits
are for Marcellus Shale waste and which are not without doing File
Review for each permit.)
Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit and
using published latitude and longitude for the well. It is possible I
may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The
DEP has been known to list a municipality incorrectly.
