Draft Technical Guidance, Substantive Revision
DEP ID: 275-2101-001. Title: Air Quality Operating Permit Protocol.
Description: The Department believes that timely and consistent permit
application determinations are necessary to ensure that the air quality
needs of the Commonwealth are fully met. The Department-wide policy
known as Money Back Guarantee (MBG) has been replaced by Permit
Decision Guarantee Program (PDGP), which sets forth enhanced permitting
procedures intended to enhance timeliness of the permitting process and
has already been implemented. This existing February 23, 1996, guidance
document which provides guidance for regional personnel in reviewing
plan approval applications and conducting permit inspections references
MBG, necessitating amendment to reference the new PDGP. In addition,
minor changes are included to reflect current program procedures that
have evolved since 1996 that also enhance the timeliness of the permit
processing. Although this policy is being updated to reflect the
current plan approval fees specified in 25 Pa. Code § 127.702 (relating
to plan approval fees), there are no fee increases established by this
policy. The scope of the policy is limited to operation of the
permitting program.
Written Comments: Interested persons may submit written comments on
this draft technical guidance document by June 3, 2013. The Department
will accept comments submitted by e-mail, but comments submitted by
facsimile will not be accepted. A return name and address must be
included in each e-mail transmission. Written comments should be

Pennsylvania's 2014 Ambient Air Monitoring Network Plan; Availability for Public Comment

On October 17, 2006, the United States Environmental Protection Agency
(EPA) promulgated final amendments to the national ambient air
monitoring requirements for criteria pollutants in 40 CFR Parts 53 and
58 (relating to ambient air monitoring reference and equivalent
methods; and ambient air quality surveillance). See 71 FR 61236
(October 17, 2006). The EPA's final rule requires state and local
agencies to enhance air monitoring to ''improve public health
protection and better inform the public about air quality in their
communities.'' Under 40 CFR 58.10 (relating to annual monitoring
network plan and periodic network assessment), air quality state and
local monitoring agencies must adopt an annual air-monitoring network
plan and make the plan available for public inspection for at least 30
days prior to final submission to the EPA Regional Administrator. The
plan, which is due July 1, 2013, must include a statement of purpose
for each monitor and evidence that siting and operation of each monitor
meets Federal requirements. The EPA may also provide an opportunity for
review and comment prior to approving or disapproving a state's
Monitoring Network Plan.
On May 4, 2013, the 2014 Annual Air Monitoring Network Plan was made
available for public comment on the Department of Environmental
Protection's (Department) web site at
www.dep.state.pa.us/dep/deputate/airwaste/aq/default.htm. The plan has
been updated to address changes that have been made in the
Commonwealth's ambient air monitoring network and to identify changes
that are anticipated to occur in 2014.
The public is invited to submit comments on this network plan.
Comments must be received by the Department on or before June 4, 2013.

26-00585: Universal Well Services / Connellsville Camp Facility (730
Braddock View Dr., P. O. Box 130, Mount Braddock, PA 15465-0130) for
the operation of a sand, cement, fly ash, and HCl storage and loading
facility for the oil and gas industry located in North Union Township,
Fayette County. In accordance with 25 Pa Code §§ 127.424 and 127.425
the Department of Environmental Protection (DEP) has received an
application and intends to issue an Air Quality Operating Permit for
the above mentioned facility.
The subject facility consists of two sand storage tipples equipped
with dust collectors, three cement/fly ash storage silos and a mixing
operation equipped with a dust collector, two HCl storage tanks
equipped with an acid scrubber, an HCl transloading operation equipped
with an acid scrubber, a waste oil heater, a diesel storage tank, and
paved and unpaved roads and surfaces. The potential emissions from the
facility are estimated to be: 0.0 tpy NOx, 0.0 tpy CO, 0.0 tpy SOx, 9.8
tpy PM, 8.2 tpy PM10, 0.0 tpy VOC, and 0.2 tpy HCl.
The facility is required to conduct a weekly survey of the facility
during daylight hours while the facility is operating to ensure
compliance with the visible emission, fugitive emission and malodor
restrictions. Records of the weekly survey performed must be recorded.
Monthly preventative maintenance inspections are to be performed on the
control devices and recorded in an on-site log. The facility is also
required to water all in-plant roads as needed to prevent fugitive
emissions across the property line, maintain a set vehicle pattern,
post speed limit sign of 15 mph as well as promptly remove earth or
other material from paved roads onto which earth or other material has
been transported by trucking or earth moving equipment, or other means.
Particulate matter emissions are not to exceed 0.04 gr/dscf. The
proposed authorization is subject to State and Federal Regulations. The
permit includes emission limits as well as operation, monitoring,
reporting, and recordkeeping requirements.
Those who wish to provide the Department with additional written
information that they believe should be considered prior to the
issuance of the Plan Approval may submit the information to Nick
Waryanka, Department of Environmental Protection, 400 Waterfront Drive,
Pittsburgh, PA, 15222. Written comments must contain the name, address
and telephone number of the person submitting the comments,
identification of the proposed Operating Permit (26-00585) and concise
statements regarding the relevancy of the information or objections to
issuance of the Operating Permit.
A public hearing may be held, if the Department, in its discretion,
decides that such a hearing is warranted based on the information
received. All persons submitting comments or requesting a hearing will
be notified of the decision to hold a hearing by publication in the
newspaper or by the Pennsylvania Bulletin, or by telephone, where the
Department determines such notification by telephone is sufficient.

[Permit #E26-07-004] Caiman Penn Midstream,
LLC, 5949 Sherry Lane, Suite 1300, Dallas, Texas 75225-8008. This
project starts at the Fike Facility Pad on the Friendsville, PA
Quadrangle at N 20 1/2 inches and W 3 1/4 inches (39° 43` 36.14", -79°
29` 35.99") and ends on the Brandonville, PA Quadrangle at N 25 inches
and W 15 7/8 inches at the Polk Facility Pad (39° 44` 45.66", -79° 31`
42.93"). The pipeline passes through Henry Clay and Wharton Townships
in Fayette County, PA, Pittsburgh ACOE District, State Water Plan Basin
19G, Upper Monongahela River Watershed. The Polk to Fike Pipeline
Project includes the construction of approximately 21,000 feet of 12"
gas gathering line with a 60 foot Right of Way (ROW), two surface
sites, and five access roads. The Project has 10 stream and 3 wetland
crossings of Fike Run (HQ-CWF) and unnamed tributaries to Fike Run
(HQ-CWF). The 10 stream crossings consist of 270 linear feet and 1,213
square feet of temporary disturbance. The crossings will be a
combination of flume pipe diversions for the utility line crossings and
temporary mobile bridges for the temporary access roads. The wetland
crossings consist of 1,853 square feet of temporary disturbance. Two
(2) wetlands crossings will be HDD bores and one crossing will utilize
an open trench with timber mats. The total disturbance for this project
is 35.1 acres. This pipeline crosses from PA into WV at latitude 39°
43` 16.21" and longitude -79° 30` 53.66".

For several kinds of permits, e.g. Erosion
& Sedimentation Permits for well pads and pipelines, and Air
Quality permits for compressor stations, an operator is required to
send municipalities by certified mail a notification of intent to apply
for the permit. Proof of having sent the notifications must be included
with the permit application to DEP. These municipal notifications go
both to the county and to the municipalities. In theory, these should
be almost the earliest form of notification we have of where Marcellus
Shale construction is going to happen. (FERC pipeline documents provide
even earlier advance notice, but only apply to interstate transmission
lines and their included compressor stations.) In practice, the
municipal notification can arrive after DEP has received a permit
application — though this is not supposed to happen. The operator is
supposed to provide a 30 day comment period to the county /
municipality. I am not aware of any case where either Fayette County or
any municipality in the county has actually made use of this comment
period, or advertised it in any fashion. I did appear at one Fayette
County Planning Commission meeting to ask some questions about a well
pad site permit during the public comment period of the meeting. I was
told by the chairman that they were “good questions” but that they
should be directed to the DEP. It is clear that the Fayette County
Planning Commission “Project Review” is completely proforma in the case
of Marcellus Shale permits. One should note that even though there is a
“municipal comment” period, these permits do not have a public comment
period administered by DEP. The county and municipalities are
throwing away the only form of public comment that exists for these permits.

Marcellus Shale waste disposal
injection wells in Pennsylvania are
regulated directly by EPA, not DEP. Notice of any new permit
applications will appear at the above web address. I'm not aware
of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.

may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The
DEP has been known to list a municipality incorrectly.
