of the Governor to submit for publication semi-annually an agenda of
regulations under development or consideration.

This rulemaking amends 25 Pa. Code §§ 78a.1 (relating to
definitions) and 78a.19 (relating to permit application fee
schedule). These amendments are necessary to increase fees
to support the administration of 58 Pa.C.S. Chapter 32
(related to development) (2012 Oil and Gas Act) by the DEP's
Office of Oil and Gas Management. The rulemaking increases
the current well permit application fees from $5,000 for
nonvertical unconventional wells and $4,200 for vertical
unconventional wells, to $12,500 for all unconventional well
permit applications to administer the 2012 Oil and Gas Act.

transmission stations. Upon promulgation, the final-form
regulation would be submitted to the EPA for approval as a

The Department of Environmental Protection (Department) announces
the opportunity for public comment on the proposed General Plan
Approval and/or General Operating Permit for Natural Gas-Fired
Combined Heat and Power Facilities (BAQ-GPA/GP-20 or GP-20).
Notice of availability of related documents and opportunity to
submit comments for GP-20 will be published in the Pennsylvania
Bulletin and in six newspapers of general circulation, and sent to
nearby states, and the United States Environmental Protection
Agency in full compliance with 25 Pa. Code § 127.612(a) (relating
to public notice and review period).
The proposed GP-20 was developed under the authority of section
6.1(f) of the Air Pollution Control Act (35 P.S. § 4006.1(f)) and
25 Pa. Code Chapter 127, Subchapter H (relating to general plan
approvals and operating permits) and will be applicable to single
or multiple natural gas-fired combined heat and power facilities
at a site with a combined maximum rated electric generating
capacity less than 25 megawatts. The emissions sources covered by
GP-20 are limited to stationary natural gas-fired spark ignition
internal combustion engines and stationary natural gas-fired
combustion turbines.
The general permit includes Best Available Technology
requirements to meet emission limits for oxides of nitrogen,
carbon monoxide, non-methane non-ethane hydrocarbons,
formaldehyde, total particulate matter and carbon dioxide.
The general permit includes initial and continuous scheduled
performance testing requirements, as well as periodic emissions
monitoring using portable emissions analyzers. The general permit
also includes monitoring, recordkeeping and reporting requirements
designed to keep the facility operating within all applicable
State and Federal air quality requirements, such as: records of
maintenance performed; municipal notifications; malfunction
reporting; and annual facility inventory reporting. All records
required must be maintained onsite or at the nearest local field
office for a minimum of 5 years. The general permit includes an
application fee of $1,700 required to authorize the construction
of sources subject to New Source Performance Standards. The
general permit includes a general operating permit application fee
of $375 and an annual operating permit administration fee of $375.
The general permit also includes an administrative amendment fee
of $300. The term for the general permit is 5 years and
authorization can be renewed before the expiration date.

A copy of the DEP Bureau of Air Quality's Review Memo on that

This facility does receive Marcellus Shale waste; the review
memo above documents that:
"The leachate is stored in 1.9 million
gallon glass-lined steel tanks equipped with secondary
containment prior to being pre-treated and pumped to the
Publicly Owned Treatment Works (POTW) in South Union
Township."
This is a major source facility in
an Environmental Justice Area, which means it qualifies as a
so-called Trigger Permit under the DEP Office of Environmental
Justice, which means it should be given a Public Comment
opportunity and assistance obtaining documents. Stay tuned.
There is reason to question the permit number. Standard practice
in the Bureau of Air Quality when a permit is amended is to
append a suffix letter the first time the permit is amended,
which is then incremented for subsequent amendments. Why is the
permit number here not 26-00402A? [This question has obviously
been answered by the change in permit number for Authorization
1309840 from 26-00402 to 26-00402C.]

The Dogbone Centralized Water
Facility has a long and complex history in which Fayette
Marcellus Watch has been deeply involved, having commented on
the original WMGR123 permit, and having alerted the Fayette
County Office of Planning, Zoning, and Community Development to
the fact that this facility needed a Special Exception from the
Zoning Hearing Board. That case, ZHB 17-41, resulted in two
hearings, at which objections were raised by members of both
Fayette Marcellus Watch and Freedom From Fracking. The Zoning
Hearing Board never issued a signed resolution in that case,
whereupon Chevron asserted a "Deemed Approval" under the
Municipalities Planning Code, meaning that they received their
Special Exception as applied for. (Apparently there was a draft
resolution from the ZHB that included conditions.) Freedom From
Fracking appealed the Deemed Approval to the Fayette County
Court of Common Pleas as Case # 1108 of 2018. That case is still
ongoing.
As originally applied for, Chevron intended to build a tank farm
consisting of 5 one-million-gallon tanks (scaled back from 6
during the application review) to contain both "fresh" water and
flowback / produced water; the intent was for water to be
delivered via both trucking and pipelines (in which water would
flow in both directions between the tank farm and well pads).
Chevron subsequently announced (orally) that their plans had
changed to only two tanks with no frackwater. This assertion was
repeated in court by Chevron's attorney during oral argument in
the appeal case.
In DEP permitting, "renewal" typically means without change. If
Chevron has no intent to store frackwater in the Dogbone
Centralized Water Facility, they don't need a WMGR123 permit.
One can only guess they are renewing the permit in preparation
for selling off their Chevron Appalachia assets (as
announced
to the public in December).
The story of exactly what happened behind the scenes in the
Zoning Hearing Board's failure to issue a signed resolution in
case ZHB 17-41 has not been made public.

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this
actually ever happening is scarce. In Fayette County, the entirety
of Redstone, Springhill, Nicholson, and German Townships are
environmental justice areas, as well as a large part of Dunbar
Township. DEP's policy document on public participation guidelines
for environmental justice areas is located here:

Marcellus Shale waste disposal
injection wells in Pennsylvania are regulated directly by EPA, not
DEP. Notice of any new permit applications will appear at the
above web address. I'm not aware of any subscription service
to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County
(yet ...) but we need to monitor this page for future
applications.

mapped parcel containing a given latitude
and longitude, are a best effort determination which is subject to
error, and are not official. In cases where a facility is leased and
there is a separate parcel id for the lease, if this parcel id is
not separately mapped, the parcel id shown will be the id for the
enclosing parcel. Parcel owners may be surface owners only and may
or may not have any relationship to oil & gas facilities.
Does not currently include water supply permits. Does not include
landfill permits even though many such are for Marcellus Shale
waste. (It is not possible at this time to distinguish which
landfill permits are for Marcellus Shale waste and which are not
without doing File Review for each permit.)
Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site.
The DEP has been known to list a municipality incorrectly.
