Pennsylvania's 2014-2015 Annual Ambient Air
Monitoring Network Plan; Available for Public Comment
[44 Pa.B. 2808]
[Saturday, May 10, 2014]
On October 17, 2006, the United States Environmental Protection Agency
(EPA) promulgated final amendments to the National ambient air
monitoring requirements for criteria pollutants at 40 CFR Parts 53 and
58 (relating to ambient air monitoring reference and equivalent
methods; and ambient air quality surveillance). See 71 FR 61236
(October 17, 2006). The EPA's final rule requires state and local
agencies to enhance air monitoring to ''improve public health
protection and better inform the public about air quality in their
communities.'' Under 40 CFR 58.10 (relating to annual monitoring
network plan and periodic network assessment), air quality state and
local monitoring agencies must adopt an annual air-monitoring network
plan and make the plan available for public inspection for at least 30
days prior to final submission to the EPA Regional Administrator. The
plan, which is due July 1, 2014, must include a statement of purpose
for each monitor and evidence that siting and operation of each monitor
meets Federal requirements. The EPA may also provide an opportunity for
review and comment prior to approving or disapproving a state's
Monitoring Network Plan.
On May 10, 2014, the 2014-2015 Annual Ambient Air Monitoring Network
Plan (Plan) will be made available for public comment on the Department
of Environmental Protection's (Department) web site at
www.dep.state.pa.us/dep/deputate/airwaste/aq/default.htm. The Plan has
been updated to address changes that have been made in the
Commonwealth's ambient air monitoring network and to identify changes
that are anticipated to occur in the remainder of 2014 and in 2015.
The public is invited to submit comments on this network plan.
Comments must be received by the Department on or before June 9, 2014.
Written comments should be sent to the attention of Nicholas Lazor,
Chief, Division of Air Quality Monitoring, Bureau of Air Quality, P. O.
Box 8468, Harrisburg, PA 17105-8468, RA-epair@pa.gov. Use ''Annual
Monitoring Network Plan'' as the subject line.

INDEPENDENT REGULATORY REVIEW COMMISSION
Action Taken by the Commission
[44 Pa.B. 2965]
[Saturday, May 17, 2014]
Approval Order
Public Meeting Held
May 1, 2014
Commissioners Voting: John F. Mizner, Esq., Chairperson; George D.
Bedwick, Vice Chairperson; W. Russell Faber; Lawrence J. Tabas, Esq.;
Dennis A. Watson, Esq.
Environmental Quality Board—
Oil and Gas Well Fee Amendments;
Regulation No. 7-483 (#3022)
On September 4, 2013, the Independent Regulatory Review Commission
(Commission) received this proposed regulation from the Environmental
Quality Board (EQB). This rulemaking amends 25 Pa. Code §§ 78.1 and
78.19. The proposed regulation was published in the September 14, 2013
Pennsylvania Bulletin with a 30-day public comment period. The
final-form regulation was submitted to the Commission on March 21, 2014.
This regulation changes the current fee schedule for oil and gas well
permits to a fixed fee of $5,000 for nonvertical unconventional wells
and $4,200 for vertical unconventional wells. The current sliding scale
fee for vertical wells will continue to apply, but under a different
category defined as ''conventional.''
We have determined this regulation is consistent with the statutory
authority of EQB (58 Pa.C.S. § 3211(d)) and the intention of the
General Assembly. Having considered all of the other criteria of the
Regulatory Review Act, we find promulgation of this regulation is in
the public interest.
By Order of the Commission:
This regulation is approved.

ENVIRONMENTAL PROTECTION AGENCY
40 CFR Chapter I
[EPA–HQ–OPPT–2011–1019; FRL–9909–13]
RIN 2070–AJ93
Hydraulic Fracturing Chemicals and Mixtures
AGENCY: Environmental Protection Agency (EPA).
ACTION: Advance notice of proposed rulemaking.
Summary
In its response to a citizen petition submitted under section 21 of the
Toxic Substances Control Act (TSCA), EPA indicated that as a first
step, it would convene a stakeholder process to develop an approach to
obtain information on chemical substances and mixtures used in
hydraulic fracturing. To gather information to inform EPA's proposal,
the Agency is issuing this advance notice of proposed rulemaking (ANPR)
and initiating a public participation process to seek comment on the
information that should be reported or disclosed for hydraulic
fracturing chemical substances and mixtures and the mechanism for
obtaining this information. This mechanism could be regulatory (under
TSCA section 8(a) and/or section 8(d)), voluntary, or a combination of
both and could include best management practices, third-party
certification and collection, and incentives for disclosure of this
information. In addition, the Agency is seeking comment on ways of
minimizing reporting burdens and costs and of avoiding the duplication
of state and other federal agency information collections, while at the
same time maximizing data available for EPA risk characterization,
external transparency, and public understanding. Also, EPA is
soliciting comments on incentives and recognition programs that could
be used to support the development and use of safer chemicals in
hydraulic fracturing.
Dates
Comments must be received on or before August 18, 2014.

Notes:
DEP does not have any air monitoring
stations in Fayette County. The Draft Air Monitoring Plan does not
change this. This issue has come up in numerous Fayette Marcellus Watch
meetings. It is extremely important that we get a strong public comment
effort on behalf of air monitoring in Fayette County. Note that the
Public Comment deadline is soon: June 9, 2014.
---
Something "serious" seems to have happened
at Shepard 6H.
There are
anecdotal reports of an
underground explosion
at this site. Shepard 6H has a violation for "Failure to report
defective, insufficient, or improperly cemented casing w/in 24 hrs or
submit plan to correct w/in 30 days" (Inspection ID 2206094, <
http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleViol.aspx?InspectionID=2206094>).
In the wake of the Bobtown explosion, one would sure like to know what
happened at the Sheperd well site. Authorization record 1022281 (<
http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleAuth.aspx?AuthID=1022281>)
is clear
evidence that at least one well at this site has
FAILED PERMANENTLY AND COMPLETELY.
What is extremely significant about Inspection Report 2266784 above is
that this is the first actual
documentation
we have that an underground explosion occurred at this well. The
inspection report does not actually use the word "explosion". But those
who would deny that an underground explosion took place at this well
need to explain how else you get well tubing "PERFORATTIONS @ 6215'".

The Toxic Substances Control Act (pronounced
"Tosca") is just about the
only major
federal environmental law that has not (yet) been Halliburdened. This
is our chance to be in on the ground floor to use this law for
regulating fracking chemicals. A strong public comment effort is
absolutely necessary. The citizen petition that has resulted in this
rulemaking was filed by EarthJustice, and is the work of Deborah
Goldberg.
------------------------
DEP
defines an environmental justice area as "any census tract where 20
percent or more individuals live in poverty, and/or 30 percent or more
of the population is minority". (See:
<
http://www.portal.state.pa.us/portal/server.pt/community/pa_environmental_justice_areas/20991>
<http://www.portal.state.pa.us/portal/server.pt/community/dep_enhanced_public_participation_policy/20988>
). There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this actually
ever happening is scarce. In Fayette County, the entirety of
Springhill, Nicholson, German, and Georges Townships are environmental
justice areas, as well as a large part of Dunbar Township. DEP's policy
document on public participation guidelines for environmental justice
areas is located here:

eNOTICE records are likely to list the same permit multiple times, as
that permit moves through the DEP process.
Oil & Gas Wells designated with a site a number and the letter H
typically designate horizontal wells.

Marcellus Shale waste disposal
injection wells in Pennsylvania are
regulated directly by EPA, not DEP. Notice of any new permit
applications will appear at the above web address. I'm not aware
of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.

-------------------------
Disclaimers:
This compilation from the above sources was done by hand using copy and
paste and may omit relevant permits.
Does not currently include water supply permits. Does not include
landfill permits even though many such are for Marcellus Shale waste.
(It is not possible at this time to distinguish which landfill permits
are for Marcellus Shale waste and which are not without doing File
Review for each permit.)
Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit and
using published latitude and longitude for the well. It is possible I
may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site. The
DEP has been known to list a municipality incorrectly.
