Fayette County Marcellus Shale Permits 5/5/14 - 5/18/14

There are 3 major news items in this bulletin:

(1) A draft of the state Ambient Air Monitoring Plan is available for public comment. There are no monitoring stations for Fayette County.

(2) We finally have actual documentation of an underground explosion at Shepard 6H in Redstone Twp.

(3) EPA has published an Advance Notice of Proposed Rulemaking to regulate fracking chemicals under the Toxic Substances Control Act.

Pennsylvania's 2014-2015 Annual Ambient Air Monitoring Network Plan; Available for Public Comment

 On October 17, 2006, the United States Environmental Protection Agency (EPA) promulgated final amendments to the National ambient air monitoring requirements for criteria pollutants at 40 CFR Parts 53 and 58 (relating to ambient air monitoring reference and equivalent methods; and ambient air quality surveillance). See 71 FR 61236 (October 17, 2006). The EPA's final rule requires state and local agencies to enhance air monitoring to ''improve public health protection and better inform the public about air quality in their communities.'' Under 40 CFR 58.10 (relating to annual monitoring network plan and periodic network assessment), air quality state and local monitoring agencies must adopt an annual air-monitoring network plan and make the plan available for public inspection for at least 30 days prior to final submission to the EPA Regional Administrator. The plan, which is due July 1, 2014, must include a statement of purpose for each monitor and evidence that siting and operation of each monitor meets Federal requirements. The EPA may also provide an opportunity for review and comment prior to approving or disapproving a state's Monitoring Network Plan.

 On May 10, 2014, the 2014-2015 Annual Ambient Air Monitoring Network Plan (Plan) will be made available for public comment on the Department of Environmental Protection's (Department) web site at www.dep.state.pa.us/dep/deputate/airwaste/aq/default.htm. The Plan has been updated to address changes that have been made in the Commonwealth's ambient air monitoring network and to identify changes that are anticipated to occur in the remainder of 2014 and in 2015.

 The public is invited to submit comments on this network plan. Comments must be received by the Department on or before June 9, 2014. Execution of Oil and Gas Lease for Publicly-Owned Streambeds

[Saturday, May 17, 2014]

 Effective December 2, 2013, an Oil and Gas Lease for Publicly-Owned Streambeds, Contract No. M-2102030-04, was executed by and between the Commonwealth, acting through the Department of Conservation and Natural Resources (Department) (lessor), and EQT Production Company (lessee), with its principal place of business located at 625 Liberty Avenue, Pittsburgh, PA 15222.

 The lease is for Streambed Tract 2030 and includes one parcel encompassing a total of 2.55 acres of submerged lands located in Morgan Township, Greene County. The lease was recorded at the Greene County Courthouse on February 27, 2014, instrument no. 201400001077. The lease allows for the development of oil and natural gas below and between the ordinary low water marks of the Tenmile Creek solely by means of directional, including horizontal, drilling on a nondevelopment basis that will not disturb the river or its bed.  On September 4, 2013, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (EQB). This rulemaking amends 25 Pa. Code §§ 78.1 and 78.19. The proposed regulation was published in the September 14, 2013 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on March 21, 2014.

 This regulation changes the current fee schedule for oil and gas well permits to a fixed fee of $5,000 for nonvertical unconventional wells and $4,200 for vertical unconventional wells. The current sliding scale fee for vertical wells will continue to apply, but under a different category defined as ''conventional.''

 We have determined this regulation is consistent with the statutory authority of EQB (58 Pa.C.S. § 3211(d)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

The Department had become aware that the well was recently vented and an inspection was completed to determine if any brine had affected the ground.  Atlas personel completed soil conductivity samples while the Department was present today.  One sample was taken inside the dike 7 feet from the tank, one sample taken  26 feet from the tank outside the dike, and one sample taken 95 feet from the tank outside the dike.  None of the samples had conductivity results over 36.5 or pH out of the 6-9 range.  No dead vegetation was observed around the site or in the vicinity of the well.  No residue of any kind was observed on the tanks or equipment or on the ground surrounding the well site. No leaks were seen coming from the equipment or tanks.

ACTION: Advance notice of proposed rulemaking.

Summary

In its response to a citizen petition submitted under section 21 of the Toxic Substances Control Act (TSCA), EPA indicated that as a first step, it would convene a stakeholder process to develop an approach to obtain information on chemical substances and mixtures used in hydraulic fracturing. To gather information to inform EPA's proposal, the Agency is issuing this advance notice of proposed rulemaking (ANPR) and initiating a public participation process to seek comment on the information that should be reported or disclosed for hydraulic fracturing chemical substances and mixtures and the mechanism for obtaining this information. This mechanism could be regulatory (under TSCA section 8(a) and/or section 8(d)), voluntary, or a combination of both and could include best management practices, third-party certification and collection, and incentives for disclosure of this information. In addition, the Agency is seeking comment on ways of minimizing reporting burdens and costs and of avoiding the duplication of state and other federal agency information collections, while at the same time maximizing data available for EPA risk characterization, external transparency, and public understanding. Also, EPA is soliciting comments on incentives and recognition programs that could be used to support the development and use of safer chemicals in hydraulic fracturing.

Notes:

DEP does not have any air monitoring stations in Fayette County. The Draft Air Monitoring Plan does not change this. This issue has come up in numerous Fayette Marcellus Watch meetings. It is extremely important that we get a strong public comment effort on behalf of air monitoring in Fayette County. Note that the Public Comment deadline is soon: June 9, 2014.

Something "serious" seems to have happened at Shepard 6H. There are anecdotal reports of an underground explosion at this site. Shepard 6H has a violation for "Failure to report defective, insufficient, or improperly cemented casing w/in 24 hrs or submit plan to correct w/in 30 days" (Inspection ID 2206094, <http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleViol.aspx?InspectionID=2206094>). In the wake of the Bobtown explosion, one would sure like to know what happened at the Sheperd well site. Authorization record 1022281 (<http://www.ahs.dep.pa.gov/eFACTSWeb/searchResults_singleAuth.aspx?AuthID=1022281>) is clear evidence that at least one well at this site has FAILED PERMANENTLY AND COMPLETELY.

What is extremely significant about Inspection Report 2266784 above is that this is the first actual documentation we have that an underground explosion occurred at this well. The inspection report does not actually use the word "explosion". But those who would deny that an underground explosion took place at this well need to explain how else you get well tubing "PERFORATTIONS @ 6215'".

The Toxic Substances Control Act (pronounced "Tosca") is just about the only major federal environmental law that has not (yet) been Halliburdened. This is our chance to be in on the ground floor to use this law for regulating fracking chemicals. A strong public comment effort is absolutely necessary. The citizen petition that has resulted in this rulemaking was filed by EarthJustice, and is the work of Deborah Goldberg.

In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. eNOTICE records are likely to list the same permit multiple times, as that permit moves through the DEP process.

Marcellus Shale waste disposal injection wells in Pennsylvania are regulated directly by EPA, not DEP. Notice of any new permit applications will appear at the above web address.  I'm not aware of any subscription service to be notified of such applications. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.

Does not currently include water supply permits. Does not include landfill permits even though many such are for Marcellus Shale waste. (It is not possible at this time to distinguish which landfill permits are for Marcellus Shale waste and which are not without doing File Review for each permit.)

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
