Draft Technical Guidance Document—Substantive Revision
DEP ID: 012-0900-003. Title: Policy on Public Participation in the
Permit Review Process. Description: Public participation is an integral
part of environmental decision making, and it is the policy of the
Department that applications for approval should provide for effective
involvement of the public. It is the intent of the Department to
respond appropriately and in a timely manner to all relevant comments
received during the permit application review process, particularly
when there is a formal public comment process. This policy establishes
a framework for public participation in the permit application review
process by providing consistent guidelines for how the Department
encourages public participation in the review of a permit application
and how it reviews and responds to comments received during the public
participation process.
Written Comments: Interested persons may submit written comments on
this draft technical guidance document by July 22, 2013. Comments
submitted by facsimile will not be accepted. Comments, including
comments submitted by e-mail must include the originator's name and

The authorization 902871 above for Shamrock
Compressor Station is for the same permit about which a hearing was
held at the New Salem Volunteer Fire Department. (This was the first
compressor station hearing ever held in the Southwest Region of the
DEP.) I have not yet received the comment response document from DEP
giving responses to the testimony. It appears our testimony had no
effect.
The compressor station RANGE RESOURCES
APPALACHIA/RUMBAUGH STA is one of only 4 in Fayette County for which we
do not have a location. Clean Air Council obtained latitude and
longitude from DEP for this facility, but they are not correct -- the
location they point to is not even in Fayette County!
Counties and Municipalities receive notification
of intent to apply for certain kinds of permits under the terms of
legislation known as Act 14. The county / municipality has a comment
period, but these are seldom utilized. Several of us from Fayette
Marcellus Watch appeared at the 6/13/2013 Fayette County Planning
Commission meeting to speak about this issue and Springhill #2
Compressor Station in particular.

DEP
defines an environmental justice area as "any census tract where 20
percent or more individuals live in poverty, and/or 30 percent or more
of the population is minority". (See:

). There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this actually
ever happening is scarce. In Fayette County, the entirety of
Springhill, Nicholson, German, and Georges Townships are environmental
justice areas, as well as a large part of Dunbar Township. DEP's policy
document on public participation guidelines for environmental justice
areas is located here:

regulated directly by EPA, not DEP. Notice of any new permit
applications will appear at the above web address. I'm not aware
of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.

with E&S permits it is by inferring an associated well permit and
using published latitude and longitude for the well. It is possible I
may be inferring the wrong well site.

DEP has been known to list a municipality incorrectly.
