Draft Technical Guidance:
Substantive Revisions
DEP ID: 275-2101-003. Title: Air Quality Permit Exemptions.
Description: Consistent with the provision of 25 Pa. Code § 127.14
(relating to exemptions), the Department may determine sources or
classes of sources which may be exempt from the plan approval and
permitting requirements of 25 Pa. Code Chapter 127 (relating to
construction, modification, reactivation and operation of sources).
In accordance with 25 Pa. Code § 127.14(d), the listing of these
determinations is being revised and a draft is now available.
TGD No. 275-2101-003 identifies the following:
• exemptions under § 127.14(a)(8) that do not require submission of
a Request for Determination form.
• exemptions under § 127.14(a)(8) that do require submission of a
Request for Determination form.
• further qualifications regarding plan approval exempted sources.
• exemptions under § 127.14(a)(9) related to physical changes.
• exemption criteria for operating permits.
This guidance document is applicable to sources, which will be
constructed as a new source, or modified after the effective date of
this TGD. It does not apply to sources which were constructed or
modified prior to the effective date of this guidance document and
operating lawfully without a permit.
Written Comments: The Department invites written comments on the
proposed list of plan approval and operating permit exemptions.
Notice and opportunity for comment will also be provided to the
United States Environmental Protection Agency and the states of
Delaware, Maryland, New Jersey, New York, Ohio, Virginia and West
Virginia.

Notice of Requirement to Submit Certain ESCGP-3 Applications through
the Department of Environmental Protection's ePermitting System
[50 Pa.B. 3548]
[Saturday, July 11, 2020]
The Department of Environmental Protection (Department) is
providing notice that persons seeking to submit New or Major
Modification Notices of Intent (NOI), or both for coverage to
conduct activities under the Erosion and Sediment Control General
Permit-3 (ESCGP-3) for Earth Disturbance Associated with Oil and Gas
Exploration, Production, Processing or Treatment Operations or
Transmission Facilities to the Department's Bureau of District Oil
and Gas Operations must submit those NOIs through the Department's
ePermitting system as the NOI form provided by the Department. See
25 Pa. Code §§ 102.1 and 102.6 (relating to definitions; and permit
application and fees). The Department's use of the ePermitting
system as the form for these NOIs will be effective September 9,
2020. After this date, the Department will no longer accept New or
Major Modification NOIs, or both submitted on paper.
The Department will continue to accept paper NOIs for Renewals
submitted to the Department's Bureau of District Oil and Gas
Operations where the existing Authorization of Coverage under the
ESCGP-3 was originally issued. In addition, NOIs for ESCGP-3s
submitted to a Conservation District of the Department's Regional
Waterways and Wetlands Program should continue to be submitted to
the appropriate office on paper. To the extent that an applicant for
coverage under the ESCGP-3 is uncertain how to submit their NOI,
they should contact the District Oil and Gas Office where the
project will be located for further information.

Notes:
The notice above for public
comment on a revision to the Technical Guidance Document "Air
Quality Permit Exemptions" is one of the most important public
comment opportunities we will see. Historically, Oi & Gas wells
received a blanket exemption from needing an air quality permit
under the notorious Exemption 38. Over the years this exemption has
seemingly been narrowed considerably, but loopholes have meant that
air quality permit applications for oil & gas wells are
extremely rare. This TGD must be examined with a fine-tooth comb to
eliminate remaining loopholes. Really, what we should be calling for
here is for Exemption 38 to simply be rescinded.

last permit was issued on
7/30/2015.
Apparently Air Quality GP-5 permits are good for 5 years; most
likely the application listed above is a straightforward
renewal, but without seeing the application we can't be certain
of that.
This facility has been the subject of extensive comment,
activity, and litigation, in which Fayette Marcellus Watch has

This facility does receive Marcellus Shale waste; the review
memo above documents that:
"The leachate is stored in 1.9 million
gallon glass-lined steel tanks equipped with secondary
containment prior to being pre-treated and pumped to
the Publicly Owned Treatment Works (POTW) in South
Union Township."
This is a major source facility
in an Environmental Justice Area, which means it qualifies as
a so-called Trigger Permit under the DEP Office of
Environmental Justice, which means it should be given a Public
Comment opportunity and assistance obtaining documents. Stay
tuned.

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this
actually ever happening is scarce. In Fayette County, the entirety
of Redstone, Springhill, Nicholson, and German Townships are
environmental justice areas, as well as a large part of Dunbar

above web address. I'm not aware of any subscription service
to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County
(yet ...) but we need to monitor this page for future
applications.

Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site.
The DEP has been known to list a municipality incorrectly.
