(Department) Policy for Development and Publication of Technical
Guidance, the Department provides notice of the availability of the
Non-Regulatory Agenda (Agenda) twice a year in February and July.
The Agenda serves as a guide and resource to the regulated
community, the public, Department staff and members of the
Department's advisory committees regarding the focus of the
Department's policy development for the coming year. The types of
documents listed in the Agenda include policies and technical
guidance documents that provide directives, guidance or other
relevant compliance-related information.

Draft Technical Guidance—Substantive Revision
DEP ID: 012-0501-002. Title: Environmental Justice Public
Participation Policy. Description: Historically, minority and
low-income residents of this Commonwealth have not had equitable
opportunities to participate in decisions that may adversely impact
their environment. This policy outlines opportunities for community
involvement and public participation in the individual permit
application process in Environmental Justice Areas. The revisions to
this policy clarify how individuals living in Environmental Justice
Areas may have additional opportunities to engage with the
Department and permit applicants through public meetings, public
comment periods, public access to permit documents and other
measures in the effort to increase participation throughout decision
making processes. To accurately capture the number of residents of
this Commonwealth living in Environmental Justice Areas, the
Department updated its definition of Environmental Justice Area to
be ''Any census block group with a 30 percent or greater minority
population or 20 percent or greater at or below the poverty level as
defined by the U.S. Census Bureau.''

Draft Stream Evaluation Reports Available for Public Comment

Under 25 Pa. Code § 93.4d (relating to processing of petitions,
evaluations and assessments to change a designated use), the
Department of Environmental Protection (Department) gives notice
that the following Draft Stream Evaluation Reports are available for
public comment on the Department's web site for a 30-day comment
period.

The Dunbar Creek evaluation was conducted in response to a request
by the Fish and Boat Commission to redesignate the Dunbar Creek
basin to Exceptional Value (EV). The Dunbar Creek basin is currently
designated High Quality—Cold Water Fishes (HQ-CWF).
The draft reports are available for review on the Department's
eComment web site at www.ahs.dep.pa.gov/eComment.
The Department has asked all the previously listed local
jurisdictions to make a copy of this notification available to any
and all interested citizens, including those who own real property
in the previously listed municipalities and to any other parties the
municipalities believe may be interested in these evaluations and
draft reports.
Interested persons may submit comments through Monday, August 13,
2018. All comments, including comments submitted by e-mail, must
include the originator's name and address. Commentators are
encouraged to submit comments using the Department's online eComment

Conclusion:
"Based on the 2006 benthic macroinvertebrate survey and the 1996
–2002, 2006,and 2016 water chemistry results; the Department
recommends that Glade Run from Rock Run to mouth be delisted from
the Commonwealth’s 303(d) list of impaired waters. In addition, the
UNT 38212 basin should be added to the listing as Source – Abandon
Mine Drainage and Cause – Metals and pH(Figures 1 & 2) .
Based on applicable regulatory definitions and requirements of §
93.4b(b)(1)(v ) (the Department’s integrated benthic
macroinvertebrate scoring test) the Department recommends that
Dunbar Creek basin from and including Limestone Run to Gist Run be
redesignated EV; and Dunbar Creek basin from source to and including
UNT 38188 and Irishtown Run basin , excluding the headwaters of
Glade Run upstream of State Game Lands 51 and those reaches of the
Glade Run basin listed or recommended for listing on the
Commonwealth’s 303(d) list of impaired waters, be redesigned EV
based on § 93.4b(b)(1)(iii) (outstanding State resource waters)
(Figures 1 -3).
This recommendation adds approximately 40.2 stream miles of EV
waters to Chapter 93."

The Department of Environmental Protection (Department) provides
notice of the following June 28, 2018, Order of the Commonwealth
Court of Pennsylvania which clarifies the compliance deadlines in 25
Pa. Code § 78a.59b(b) (relating to well development impoundments).
The Commonwealth Court issued its Order in response to an Amended
Joint Application for Relief Requesting Clarification of the
Compliance Deadlines in 25 Pa. Code § 78a.59b(b) filed by the
Department, the Environmental Quality Board and the Marcellus Shale
Coalition in the case of Marcellus Shale Coalition v. Department of
Environmental Protection of the Commonwealth of Pennsylvania and
Environmental Quality Board of the Commonwealth of Pennsylvania,
Commonwealth Court Docket No. 573 MD 2016. The Commonwealth Court's
Order, at Paragraph 2, directs the Department to publicize the Order
in the Pennsylvania Bulletin, notifying the regulated community and
public of the correct compliance dates.
The Commonwealth Court's Order extends the December 7, 2016,
deadline from 25 Pa. Code § 78a.59b(b) to Monday, August 27, 2018,
and extends the October 10, 2017, deadline from 25 Pa. Code
§ 78a.59b(b) to Friday, June 28, 2019.

Joint Application for Relief Requesting Clarification of the

Expedited Review (Amended Joint Application), the Amended Joint
Application is hereby Granted. This Court previously enjoined
enforcement of 25 Pa. Code § 78a.59b(b) by preliminary injunction
issued on November 8, 2016, and the Pennsylvania Supreme Court
reversed this Court's preliminary injunction as to this specific
regulation in its decision dated June 1, 2018. To provide for
clarity as to the time periods for compliance with the requirements
set forth in 25 Pa. Code § 78a.59b(b), it is hereby Ordered:
1. The December 7, 2016 deadline set forth in 25 Pa. Code
§ 78a.59b(b) shall be extended to 60 days from the date of this
order, and the October 10, 2017 deadline set forth in 25 Pa. Code
§ 78a.59b(b) shall be extended to one year from the date of this
Order.
2. The Pennsylvania Department of Environmental Protection shall
submit this Order for publication in the Pennsylvania Bulletin on
the next submission deadline following the date of this Order.

The Department of Environmental Protection (Department) is
proposing to reissue the Erosion and Sediment Control General Permit
for Earth Disturbance Associated with Oil and Gas Exploration,
Production, Processing or Treatment Operations or Transmission
Facilities (ESCGP-3). This general permit is issued under the
authority of The Clean Streams Law (35 P.S. §§ 691.1—691.1001). The
Department is not proposing significant changes in ESCGP-3 from
ESCGP-2 at this time. The current ESCGP-2 is scheduled to expire at
midnight on December 29, 2018.
The ESCGP-3 document is available on the Department's web site at

The Environmental Quality Board (Board) proposes to amend §§ 78a.1
and 78a.19 (relating to definitions; and permit application fee
schedule) to read as set forth in Annex A. This proposed rulemaking
complies with the obligation of the Department of Environmental
Protection (Department), as specified in § 78.19(e) (relating to
permit application fee schedule) and § 78a.19(b), to provide the
Board with an evaluation of the well permit application fees in
Chapters 78 and 78a (relating to oil and gas wells; and
unconventional wells) and recommend regulatory amendments to address
any disparity between income generated by the well permit
application fees and the cost of administering 58 Pa.C.S. Chapter 32
(relating to development) (2012 Oil and Gas Act) by the Department's
Office of Oil and Gas Management (collectively, the Oil and Gas
Program (Program)). This proposed rulemaking increases the current
well permit application fees from $5,000 for nonvertical
unconventional wells and $4,200 for vertical unconventional wells to
$12,500 for all unconventional well permit applications. Because
these proposed fee amendments only apply to Chapter 78a and not
Chapter 78, conventional well operators are not affected by this
proposed rulemaking.
This proposed rulemaking was adopted by the Board at its meeting on
May 16, 2018.

STEWART WELL CONNECT appears to be the first instance ever to appear
in this bulletin (going back to 2011!) to carry a status of
"Waived". Apparently DEP is telling Laurel Mountain Midstream that
they didn't need a permit at all -- though this is complete
speculation.
The eFACTS system as presented to us over the Web -- outside of DEP
-- unfortunately does not allow a query parameter for the Status
field. (This is extremely unfortunate; it would be nice to be able
to query for Status Pending!)

third try for what appears to be
a "termination notice" for the Erosion & Sedimentation Permit
for the Baer Well Pad. (No wells were actually drilled on this pad.)

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this
actually ever happening is scarce. In Fayette County, the entirety

environmental justice areas, as well as a large part of Dunbar
