3. Department Responsibilities. The Department shall
establish clear guidance that describes permit application requirements.
The permit decision guarantee policy developed by the Department
for implementation of this Executive Order shall include a predictable
processing time for each permit application covered by the permit
decision guarantee. The policy shall establish that the Department
will strive to process environmentally-protective applications as
expeditiously as possible, but no longer than the established processing
times. The policy shall indicate that only applications that are
complete and technically adequate shall be eligible for the permit
decision guarantee and that incomplete or severely deficient
applications shall be returned to the applicant. The processing
time shall be the total number of business days beginning with the
receipt of an application and ending with the final action by the
Department.

Because 58 Pa. C.S. ᄃ3304 requires all oil and gas operations in all
zoning districts, including residential districts, as a matter of law, we hold that 58
Pa. C.S. ᄃ3304 violates substantive due process because it allows incompatible uses
in zoning districts and does not protect the interests of neighboring property owners
from harm, alters the character of the neighborhood, and makes irrational
classifications. Accordingly we grant Petitioners? Motion for Summary Relief,
declare 58 Pa C.S. ᄃ3304 unconstitutional and null and void, and permanently
enjoin the Commonwealth from enforcing it. Other than 58 Pa. C.S. ᄃᄃ3301
through 3303, which remain in full force and effect, the remaining provisions of
Chapter 33 that enforce 58 Pa. C.S. ᄃ3304 are similarly enjoined.

Notes:
The main effect as I understand it of Gov. Corbett's Executive Order
2012-11 is to replace the "clocked" money-back guarantee system for
issuing permits by a clocked system in which if the clock runs out, the
permit is automatically issued. Not clear in the case of Air Quality
permits is whether this violates the terms of Pennsylvania's EPA State
Implementation Plan (SIP). (The Pennsylvania Air Pollution Control Act,
which is the statutory authority for Air Quality permits, incorporates
by reference major sections of the federal Clean Air Act, and DEP acts
as the "agent" of the EPA under the terms of the SIP.) Also not clear
what the remedy would be if Executive Order 2012-11 does violate the
terms of the SIP. SIPs are reviewed periodically by the EPA in a process
known as the State Review Framework (SRF) (<http://www.epa.gov/compliance/state/srf/>).
I don't know whether there is a role for public participation in SRF.
Since public participation deficiencies are a frequent topic in SRF
reports, it would be ironic to say the least if SRF has no avenue for
public participation. SRF occurs in "rounds"; Round 1 is already
complete and Pennsylvania is one of a few states awaiting Round 2.
Pennsylvania is due for SRF Round 2 in 2012.
58 Pa. C.S. is the formal legal citation for Act 13. The ruling striking
down section 3304 of Act 13 was appealed on Friday, 7/28/2012 by Gov.
Corbett to the Pennsylvania Supreme Court. As far as I know, the court's
order nullifying section 3304 remains in force until and unless it is
reversed by the PA Supreme Court.
It is a good guess that the POLK TO FIKE PIPELINE connects to the Fike
Connect Compressor Station in Henry Clay Twp. We are *still* without a
more exact location for this compressor station than the township. The
location shown above for "POLK TO FIKE PIPELINE PROJECT - JOINT PERMIT"
(Authorization 934487) may be the location of a stream crossing, and not
the location of either endpoint for this pipeline. Publication of
latitude / longitude by DEP for an E&S permit is unusual.
The eMapPA links for the Rejis wells do not work yet, so there is no
location information for these wells. Perhaps the records in eFACTS are
so new the eMapPA system has not yet been updated.
The Duke Energy Fayette II Fayette Energy Center is a gas-fired power
plant. Listing it here is arguably off-topic, but I am listing it anyway
as a major user of Marcellus Shale gas. (It is also one of the few
Major Source facilities in Fayette County.)
The URL for the Well Details Report (in the Resources section below) has
*changed*. The URL for the Well Details Report published in previous
editions of this bulletin will no longer work.
