On August 19, 2014, the Environmental Quality Board (Board) accepted
the Department of Environmental Protection's (Department)
recommendation not to accept a petition for rulemaking. This decision
is in response to a petition submitted by Ashley Funk (petitioner) that
requested the establishment of a rule in this Commonwealth to regulate
fossil fuel carbon dioxide (CO2) emissions and to establish an
emissions reduction strategy that proposed to further reduce
atmospheric concentrations of CO2 by 2100.
The decision to accept the recommendation to deny the petition was
based on a report prepared by the Department and subsequent comments
provided by the petitioner. The Department determined, and the Board
concurred, that the Commonwealth is making a committed effort to
implement a variety of initiatives to reduce greenhouse gas (GHG)
emissions. The Commonwealth has implemented, and will continue to
evaluate and implement, a number of cost-effective GHG reduction
strategies for all major source categories. In addition, as National
policies or regulations are adopted, they will be implemented by the
Commonwealth. Further, adopting the measures recommended in the
petition for the Commonwealth will not achieve the emissions reductions
proposed in the petition and, thus, adoption of these measures is not
practical at this time. The Department affirmed to the petitioner that
it will continue to evaluate and implement cost-effective GHG emission
reduction strategies in order to protect the health and environmental
resources in this Commonwealth.

Operator on 8/25/2014. The Operator reported approximately 100
barrels of drilling mud spilled onto containment at 13:30. During
the inspection the Department observed a 80'x60' area where drilling
mud spilled on containment. No visible impact to the ground and
no waters of the commonwealth impacted. The Operator indicated
that the cellars of the well are concrete and the containment is sealed
to the top of the cellar. The Department suggests the Operator
remove the containment and visually inspect to ensure the spill was
contained. The Operator is currently in compliance with the most
recent Department spill policy.

Notes:
Although it's not completely clear at this
writing, it appears the Drill & Operate Well Permit Drill Deeper
permit for Rosa Unit 7H above is part of a
disturbing trend.
According to letters nearby landowners have been receiving recently
from Chevron, Chevron has been applying for Drill & Operate Well
Permit Drill Deeper permits for wells that are already drilled,
entirely and only for the purpose of reclassifying them as Conservation
Wells. Conventional wisdom is that the Oil & Gas Conservation Law (
which
includes Forced Pooling
provisions) does not apply to the Marcellus Shale -- except for
Conservation Wells. (The legal basis for this is murky.) Permitting of
"Marcellus Conservation Wells" has been going on for years, there are a
substantial number of them, including many in Fayette County. However,
"repermitting" a well only to classify it as a conservation well may be
something new. Why is Chevron doing this? Are they hoping to lay the
basis for asserting Forced Pooling for Marcellus Shale? We don't know,
but need to be alert for this. Such a permit would be an interesting
candidate for appeal.
MAWC 7020 3H is a well that was permitted
INACTIVE by Triana -- permit issued 9/3/2013. It is not clear the
authorization above for the MAWC 7020 well site is the same pad,
although you would think so.

defines an environmental justice area as "any census tract where 20
percent or more individuals live in poverty, and/or 30 percent or more
of the population is minority". (See:

). There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this actually
ever happening is scarce. In Fayette County, the entirety of
Springhill, Nicholson, German, and Georges Townships are environmental
justice areas, as well as a large part of Dunbar Township. DEP's policy

of any subscription service to be notified of such applications. I'm
not aware of any Marcellus Shale waste disposal injection wells in
Fayette County (yet ...) but we need to monitor this page for future
applications.
