Executive Order 1996-1 requires all agencies under the jurisdiction of the Governor to submit for publication an agenda of regulations under development or consideration. Subsequent agendas will be published on the first Saturdays in February and July.

 The agendas are compiled to provide members of the regulated community advanced notice of regulatory activity. It is the intention of the Administration that these agendas will serve to increase public participation in the regulatory process.

 Agency contacts should be contacted for more information regarding the regulation and the procedure for submitting comments.

 This Agenda represents the Administration's present intentions regarding future regulations. The nature and complexity of an individual regulation obviously will determine whether and when any particular regulation listed below (as well as any considered subsequent to publication of this Agenda) is published.

ENVIRONMENTAL HEARING BOARD

Practice and Procedure     The Environmental Hearing Board has submitted proposed rulemaking which is expected to be published in the Pa. Bulletin in May 2013.     The Environmental Hearing Board intends to propose the following revisions to its rules of practice and procedure: 1) correct an omission in the language of 25 Pa. Code § 1021.51 which was amended in 2009, 2) eliminate its rules pertaining to the Costs Act which has expired, 3) adopt rules to implement mandatory electronic filing, and 4) clarify the types of responses that may be filed to a dispositive motion.    Maryanne Wesdock

Emissions of Particulate Matter
Air Pollution Control Act
25 Pa. Code Chapter 139    Fall 2013, as final     The final rulemaking amends 25 Pa. Code § 139.12 (relating to emissions of particulate matter) to reflect changes in Federal test method requirements. The Environmental Quality Board amended § 139.12 at 27 Pa.B. 6804 (December 27, 1997) to require source testing only for filterable particulate matter. The United States Environmental Protection Agency has revised the source test method (Method 202) to require the testing of both filterable and condensable particulate matter for purposes of emission inventories and new source review applicability determinations. Other clarifying amendments to Chapter 139 (relating to sampling and testing) addressing timeliness of reporting requirements are also included.    Susan Hoyle

Notes:

There seem to be no fewer than three site records for the well site Sheperd 4H-7H: Site ID 774269 SHEPERD UNIT 4H - 7H, Site ID 749155 SHEPERD 4H-7H ESCGP-EXPEDITED, and Site ID 760254 SHEPERD UNIT 4H OG WELL. This 3rd site, in the municipalities section, lists every municipality in Fayette County, including Fayette County itself!!! I've noted several other errors in eFACTS before, but this one is the most colossal mess I've ever seen. The municipality botch here is so obvious that it looks as though no one inside DEP even looked at it. One assumes this record was created by a computer program with a really bad undetected bug. This is really disturbing.

The Magnablend Everson Plant seems to be a chemical blending facility. See <http://www.magnablend.com/northeast.html> and <http://www.magnablend.com/oilfieldservices.html> for a description of their "energy services". They clearly advertise they make drilling fluid. Whether they make fracking chemicals or not is not clear.

There are 3 site records for "Springhill to Bezjak Pipeline": Sute ID 772071 SPRINGHILL TO BEZJAK PIPELINE, Site ID 744222 SPRINGHILL CS TO BEZJAK PIPELINE ESGPX-EXPEDITED, and Site ID 752847 SPRINGHILL TO BEZJAK PIPELINE.

As the previous issue revealed, DEP issued the permit for Shamrock Compressor Station about which the hearing was held at the New Salem Volunteer Fire Department. DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. Does not currently include water supply permits. Does not include landfill permits even though many such are for Marcellus Shale waste. (It is not possible at this time to distinguish which landfill permits are for Marcellus Shale waste and which are not without doing File Review for each permit.)

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
