documents had been placed at the site. The E&S controls were
installed and appeared to be in good condition. The well pad was
being constructed and is expected to be completed by mid October. A
redline approval was granted to permit the construction of the
detention basin during Phase 1 in order to reduce earth disturbance.
Chevron indicated that the area around the access road is to be
seeded and mulched the following week. Once the well pad is finished
drilling activities may commence. There were no violations observed
at the time of inspection.

Notes:
The "water pipelines" shown in the
Luzerne Detail map above are not
listed for authorizations in this bulletin, but should be considered
together with the Dogbone Centralized Water Facility as a single
integrated project. The Dog Bone Waterline is shown in the
construction plans included in File Review Documents for the Dogbone
Centralized Water Facility as being "overlaid" by it but without
explicit connections; however a connection diagram for the tank
equipment shows a clear intent to connect the tank farm to
pipelines, and for pipelines to carry "water" in both directions.
The 7/24/2017 Deficiency Letter directs Chevron to submit a
Transportation Plan. Connected water pipelines would in fact
transport the residual waste covered in the permit, so should (but
might not) be included in the transportation plan.
File Review documents for the 4-H (Young) pipeline clearly show that
it is connected to the intake at the Monongahela River covered in
Chevron's Water Management Plan "Monongahela River Source 47". The
documents taken together clearly establish that Chevron plans a
connected hydrological pathway from the Monongahela River to the 6
million gallon tank farm at the Dogbone Centralized Water Facility.
The outline of the tank farm and all of the associated pipelines and
water facilities are shown on an
integrated
topographic map above (along with parcel outlines).
Chevron has been notified that the Dogbone Centralized Water
Facility will require a Special Exception as a Public / Private
Works from the Fayette County Zoning Hearing Board. This will
clearly be one of the most important cases in the history Fayette
County's experience with Marcellus Shale. Stay tuned.

(This letter is a quite large document, but most of the length is
taken by Act 14 notifications which DEP should already have but were
provided for convenience.)
Act 14 is a state law requiring applicants for several types of
permits to notify every county and municipality in which the project
will take place, and providing local government with a 30-day
comment period. These permits typically do not allow any other type
of public comment.

The
Modification
Permit for Siegel 1 has a section Special Permit Conditions
that includes this:
"WELL MAY PENETRATE VOID AREA (Pittsburgh coal seam). Use caution
when drilling near potential void areas. If void areas are
encountered, case and cement the well according to §78a.83, to
prevent the migration of gas or other fluids into coal seam and
notify your Oil & Gas Inspector."

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

There are supposed to be enhanced public participation requirements
for permits in environmental justice areas, but news of this
actually ever happening is scarce. In Fayette County, the entirety
of Springhill, Nicholson, German, and Georges Townships are
environmental justice areas, as well as a large part of Dunbar
Township. DEP's policy document on public participation guidelines
for environmental justice areas is located here:

Marcellus Shale waste disposal
injection wells in Pennsylvania are regulated directly by EPA, not
DEP. Notice of any new permit applications will appear at the
above web address. I'm not aware of any subscription service
to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County
(yet ...) but we need to monitor this page for future
applications.

that agency and associated web sites. Presumed Parcel Ids are
determined as the
mapped parcel containing a given latitude
and longitude, are a best effort determination which is subject to
error, and are not official. In cases where a facility is leased and
there is a separate parcel id for the lease, if this parcel id is
not separately mapped, the parcel id shown will be the id for the
enclosing parcel. Parcel owners may be surface owners only and may
or may not have any relationship to oil & gas facilities.
Does not currently include water supply permits. Does not include
landfill permits even though many such are for Marcellus Shale
waste. (It is not possible at this time to distinguish which
landfill permits are for Marcellus Shale waste and which are not
without doing File Review for each permit.)
Erosion & Sedimentation permit records do not currently include
latitude and longitude. Where I am publishing latitude and longitude
with E&S permits it is by inferring an associated well permit
and using published latitude and longitude for the well. It is
possible I may be inferring the wrong well site.
Municipalities are shown from eFACTS records on the DEP web site.
The DEP has been known to list a municipality incorrectly.
