Additional RACT Requirements for Major Sources of NOx and VOCs

The Environmental Quality Board (Board) amends Chapters 121 and 129
(relating to general provisions; and standards for sources) to read
as set forth in Annex A. The final-form rulemaking amends Chapter
129 to adopt presumptive reasonably available control technology
(RACT) requirements and RACT emission limitations for certain major
stationary sources of oxides of nitrogen (NOx) and volatile organic
compound (VOC) emissions. The final-form rulemaking also provides
for a petition process for an alternative compliance schedule, a
facility-wide or system-wide NOx emissions averaging plan provision,
an alternative RACT proposal petition process, and compliance
demonstration and recordkeeping requirements.
The final-form rulemaking also amends § 121.1 (relating to
definitions) to revise or add terms to support the final-form
amendments to Chapter 129.
This order was adopted by the Board at its meeting of November 17,
2015.

Notes:
We have no fewer than four wells in this
issue with applications for "Well Plugging Notice Intent to Plug
Single Well" where the operator earlier apparently tried to avoid
plugging by filing for inactive status, but those permits were
denied. DEP appears to be cracking down on this, if nothing else.
The wells are: USX - J D BRADISH 1, JAY E LEONARD UNIT 628 1,
LUZ-HOGSETT 1, and GARAFOLA 1.
For a pipeline permit, the list
labeled "Presumed Parcel IDs Include" is derived from those
locations where DEP has listed a latitude and longitude (e.g. stream
crossings) together with some parcels whose ID may be able to be
inferred by interpolation.
Such a list may be incomplete.

remain outstanding for incidents in Inactive status.

this "corrective action" is what the permit above is for, rather
than new wells at this site.

It's not clear from the eFACTS record for the
Texas Eastern authorization 1134139 above, but an educated guess is
that this is for remediation of the Shamrock Vicinity Sinkhole

The March 10, 2016 meeting of the Fayette County Planning Commission
listed the following "Project Review" item: "Texas Eastern
Transmission, L.P. applying to DEP for the New Salem Utility Line
Maintenance Project located in Menallen Township." For the

to the one shown for the SPRINGHILL CS TO BEZJAK PIPELINE
GP05260716001 project (whose property this project crosses) reports
that this pipeline is already long since in the ground, and the
permit being applied for is seriously retroactive. (Note: The
correct name of the road shown on OpenStreetMap as "Cagy Road" is
actually Volek Road.)

DEP defines an environmental justice area
as "any census tract where 20 percent or more individuals live in
poverty, and/or 30 percent or more of the population is minority".

injection wells in Pennsylvania are regulated directly by EPA, not
DEP. Notice of any new permit applications will appear at the
above web address. I'm not aware of any subscription service
to be notified of such applications. I'm not aware of any
Marcellus Shale waste disposal injection wells in Fayette County
(yet ...) but we need to monitor this page for future
applications.

possible I may be inferring the wrong well site.
