Fayette County Marcellus Shale Permits 1/15/18 - 1/28/18

The big news in this bulletin is 3 new Chevron well pads in German Twp. (That makes 4 new well pads in German Twp with the Kovach B pad which just appeared in the 12/17/17 issue of this bulletin; not to mention that the Zalac well pad in German Twp is Chevron's most recently-fracked well site.) Together with all the activity in Luzerne Twp, there can't be much doubt of a ramp-up in at least permitting, if not yet drilling.

Notes:

The Dogbone Centralized Water Facility was the subject of a Fayette County Zoning Hearing Board hearing on 12/13/2017, at which Chevron presented a topographic map including "proposed" pipelines. An unofficial copy of that map is available here:

(and as the right-hand map in the "More Maps" section above). Although the pipelines show on this map as "proposed", the pipeline routings clearly include sections of existing pipelines, including the 4-H (Young) Pipeline and the buried section of the Dog Bone Waterline.

The hearing has been continued, with the continuance currently scheduled for 2/28/2018, 10 a.m., Fayette County Public Service Building, 22 East Main St., Uniontown PA.

There appears to be no visible difference (that can be discerned from the eFACTS web interface) between the current eFACTS entry for this facility vs. the previous time this authorization was listed in eNOTICE. There is presumably a difference in some database column or other that we are not seeing over the web.

The authorization record above for STEWART 7H shows Status as Pending; however the Open Data Repository record for this well shows the permit date as 2018-01-26, suggesting that the permit has in fact been issued and that the two databases are not automatically sync'ed.

There is something important to note about the inspection report above of the well Lee 11. As a mere comment, the inspector notes: "It is recommended the tanks be inspected to ensure integrity." This is a head-shaker. Why didn't that inspector just do that inspection at the time? The answer seems to be that DEP apparently has two totally separate crews doing inspections at well sites: one crew inspects the well pad Erosion & Sedimentation permits, and a separate crew inspects the actual wells and well equipment. Why can't these crews be cross-trained and do both kinds of inspections? If all an inspector can do when noting a problem that should be handled by the "other kind" of inspector is "recommend" in a comment, there is too much room for error in whether that "recommended" second inspection actually happens.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:
<http://www.dep.pa.gov/PublicParticipation/OfficeofEnvironmentalJustice/Pages/default.aspx>). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. Marcellus Shale waste disposal injection wells in Pennsylvania are regulated directly by EPA, not DEP. Notice of any new permit applications will appear at the above web address.  I'm not aware of any subscription service to be notified of such applications. I'm not aware of any Marcellus Shale waste disposal injection wells in Fayette County (yet ...) but we need to monitor this page for future applications.

Parcel data is provided via the tax records search web page offered by the Fayette County Assessment Office (http://property.co.fayette.pa.us/). Presumed Parcel Id links are subject to availability provided by that agency and associated web sites. Presumed Parcel Ids are determined as the mapped parcel containing a given latitude and longitude, are a best effort determination which is subject to error, and are not official. In cases where a facility is leased and there is a separate parcel id for the lease, if this parcel id is not separately mapped, the parcel id shown will be the id for the enclosing parcel. Parcel owners may be surface owners only and may or may not have any relationship to oil & gas facilities.

Does not currently include water supply permits. Does not include landfill permits even though many such are for Marcellus Shale waste. (It is not possible at this time to distinguish which landfill permits are for Marcellus Shale waste and which are not without doing File Review for each permit.)

Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
