Environmental Protection Performance Standards at Oil and Gas Well Sites Rulemaking; Public Comment Period Extension

The public comment period on the proposed environmental protection performance standards at oil and gas well sites rulemaking for 25 Pa. Code Chapter 78 (relating to oil and gas wells) is extended to March 14, 2014. In addition to the comment period extension, the Environmental Quality Board (Board) will be holding two additional public hearings on the proposed regulation to gather public comments.
The first additional hearing will be held on February 10, 2014, at the Troy High School, 150 High Street, Troy, PA 16947. The second additional hearing will be held on February 12, 2014, at the Warren County Courthouse, 204 4th Avenue, Warren, PA 16365.
The proposed rulemaking was published at 43 Pa.B. 7377 (December 14, 2013) and is available online at www.dep.state.pa.us by clicking on ''Proposed Oil and Gas Regulations.''
Interested persons are invited to submit written comments, suggestions or objections regarding the proposed rulemaking to the Board. Comments, suggestions or objections must be received by the Board by March 14, 2014. Comments submitted by facsimile will not be accepted. In addition to the submission of comments, interested persons may also submit a one-page summary of their comments to the Board. The summary of comments must also be received by March 14, 2014, and will be distributed to the Board and available publicly prior to the meeting when the final rulemaking will be considered by the Board.
Comments including the submission of a one-page summary of comments may be submitted to the Board online, by e-mail, by mail or express mail as follows. If an acknowledgement of comments submitted online or by e-mail is not received by the sender within 2 working days, the comments should be retransmitted to the Board to ensure receipt.

INSPECTION COMMENT: On Monday, January 13, 2014, the Department received a report about a spill that had occurred the previous day on XTO?s Helen Bukovac #4H site; I investigated on January 14, 2014.
The site was a Marcellus well, some production equipment and two 210 bbl production tanks floating together for a total capacity of 420 bbl (17,640 gallon); these tanks contained primarily weak brine.
Sometime during the night of January 11th and 12th the brine froze a valve causing #1 tank (the north tank) to fail. The produce water went to containment, but, since the containment was earthen it seeped through to the outside.
XTO discovered the problem during the morning of the 12th, called the Department and initiated a response. They closed in the wells, called in a vacuum truck that recovered 29 bbl of material and contracted an excavating company. They were planning on excavating until tests indicated soil to background. XTO also has plans to permanently remove the damaged tank.

The listing above for TEAM 2014 PROJECT GAS PIPELINE is quite curious. It seems to be for the Environmental Assessment done for FERC. There are many mysteries about this eFACTS record. Why did it not show up in eNOTICE until 1/24/2014? What exactly is the eMapPA location mapping? (Municipalities are listed for the whole pipeline all the way across multiple counties.) Due to these uncertainties, this record is not shown in the maps.
The Drill & Operate Well permit for Knight 14H was issued on 10/5/2012. None of the Knight wells listed above are showing in the Well Details Report. It appears they may never have gone into production.
The OpenStreetMap map linked above for Shamrock Compressor Station incorrectly labels the property as "Texas Eastern Transmission". Shamrock Compressor Station is connected to the Texas Eastern pipeline, but is owned and operated by Laurel Mountain Midstream, not Texas Eastern.
XTO, operator of the HELEN K BUKOVAC 4H well noted above for a spill violation, is a subsidiary of Exxon Mobil. It in turn owns Mountain Gathering, which operates some compressor stations in Fayette County. XTO has been quite quiet on the permit front for many months now.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce.
