Implementation Order Regarding Chapter 23
[This implementation order is quite lengthy, so I won't include it; to
read the order follow the link below. However, here is a brief excerpt
pertaining to the zoning issue, which has arisen in Fayette County
recently:]
On March 29, 2012, a Petition for Review was filed in the Commonwealth
Court challenging the constitutionality of Act 13 of 2012, the
Unconventional Gas Well Impact Fee Act (Act 13). Robinson Township, et
al. v. Commonwealth, et al., No. 284 M.D. 2012. Due to uncertainty
surrounding the pending litigation, the Commission will not address the
provisions of Chapter 33 at this time.

26-00588: Laurel Mountain Midstream, LLC (1550 Coraopolis Heights Road,
Suite 140, Moon Township, PA 15108) on May 11, 2012, to extend the
period of temporary operation of the three new ultra lean burn natural
gas-fired compressor engines rated at 1,380 bhp each and controlled by
oxidation catalysts, and to allow the continued construction of the
natural gas-fired turbine rated at 16,847 bhp covered under plan
approval PA-26-00588 until November 16, 2012, at Shamrock Compressor
Station in German Township, Fayette County. The plan approval has been
extended.

eMapPA is not functioning today -- there appears to be a server problem.
Location information for this issue is taken either from the Well
Details Report (URL below) or prior editions of this permit list.
There appears to be no recent eFACTS authorization record for site
COCHRAN WELL #22H & #23H relating to the notice in the PA Bulletin.
I'm not certain what accounts for this.
In the eFACTS record for authorization 922426, SKOVRAN WELL SITES
29/32H/33H ESCGP-1 EXPEDITED, the Site link brings up search results
with no matches. This appears to be a database error at DEP. It looks to
me as though the correct site record is Site ID 729751,

This shows as Inactive. I'm guessing that the authorization simply shows the marking of the site record inactive.
The site "CLEMMER UNIT WELL ESCGP-EXPEDITED" has apparently been deleted
from the eFACTS database. You can access information about this site
from the 11/6/11 issue of my permit list. The Site ID was shown there as
897954. Deleting the site record from the database when an
authorization is withdrawn is not the correct procedure. This site is
presumably located in roughly the same place as the well Clemmer 6,
which is located at: 39.76652,-79.835548 <http://mapq.st/Kx9wCD>.
We are still without a location for the Fike Connect Compressor Station
more specific than Henry Clay Township. If this site is associated with
the FIKE UNIT 1H OG WELL above, then that would provide a location.
If you testified at the Public Input Hearing in Fayette County in the
Peregrine case, you will want to read Judge Colwell's Recommended
Decision. You may find yourself quoted. It was a very favorable ruling.
As far as I know, unless something "unusual" happens this next goes
before the PUC. In a prior case (Laser) regarding eminent domain for a
gathering line, the PUC *did* overturn Judge Colwell's Recommended
Decision, so this could happen here, but I hope not. We'll just have to
await the final ruling from the PUC.
[Repeat item from the 4/22/12 issue:] The site "ACCIDENT SITE 1 & 2"
for authorization 923863 is shown on the eFACTS record for site ID
760731,

as having address NELSON RD, LAUREL POND, WHARTON, PA 15437. This
does not agree with the eMapPA location, which is very close to the
Texas Eastern compressor station. Accident? If there has been a Texas
Eastern accident, this is "news".

eNOTICE records are likely to list the same permit multiple times, as that permit moves through the DEP process.
Oil & Gas Wells designated with a site a number and the letter H typically designate horizontal wells.
