Water Quality Toxics Management Strategy—State-ment of Policy

 The Department of Environmental Protection (Department) is amending Chapter 16 (relating to water quality toxics management strategy—statement of policy). These amendments complement the triennial review and revision of Chapter 93 (relating to water quality standards). See 43 Pa.B. 4080 (July 20, 2013) for the final-form rulemaking.

A. Effective Date

 This final statement of policy will be effective on July 20, 2013.

Appendix A. Table 1A. Site-specific water quality criteria for toxic substances

 1,4-Dioxane—Based on comments to the proposed amendments to Chapter 93 received by the EQB, the proposed Statewide criterion for 1,4-dioxane was withdrawn from this final statement of policy, but retained as a site-specific criterion (3 µg/L) in Table 1A.

 A copy of the final amendments is available from the Division of Water Quality Standards at the address provided in Section B.

DEP's instructions for the Notice of Intent for an E&S permit ESCGP-1 (since superseded by ESCGP-2) states: "An OG-57 waiver request must be submitted for any well site which lies within 100 feet of a blue line stream on a USGS Quad map or within 100 feet of any wetland greater than one acre in size."

eFACTS shows the Texas Instruments Uniontown Compressor Station as being in Uniontown and North Union Twp. The Uniontown attribution seems to be incorrect. The authorization in this issue is for a renewal of the current permit, not construction for the upgrade in the FERC TEAM 2014 project. The site name seems to have been changed from "TEXAS EASTERN TRANS UNIONTOWN STA" to how it shows above, "TEXAS EASTERN TRANS LP UNIONTOWN". Searching sites by site name pattern for compressor stations is NOT RELIABLE.

There seem to be no fewer than three site records for the well site Sheperd 4H-7H: Site ID 774269 SHEPERD UNIT 4H - 7H, Site ID 749155 SHEPERD 4H-7H ESCGP-EXPEDITED, and Site ID 760254 SHEPERD UNIT 4H OG WELL. This 3rd site, in the municipalities section, lists every municipality in Fayette County, including Fayette County itself!!! I've noted several other errors in eFACTS before, but this one is the most colossal mess I've ever seen. The municipality botch here is so obvious that it looks as though no one inside DEP even looked at it. One assumes this record was created by a computer program with a really bad undetected bug. This is really disturbing.

The Magnablend Everson Plant seems to be a chemical blending facility. See <http://www.magnablend.com/northeast.html> and <http://www.magnablend.com/oilfieldservices.html> for a description of their "energy services". They clearly advertise they make drilling fluid. Whether they make fracking chemicals or not is not clear.

An Air modeling Study is a mathematical model (i.e. software) which attempts to calculate actual expected dosage amounts of air pollutants, based on air emissions data, meteorological data, topography, and other factors. The Texas Eastern study referenced above used air monitoring data from Washington County as the "closest available". Clean Air Council has used modeling to show that compressor station air pollution may be way over what are supposed to be the limits. See:

DEP does not typically require modeling for compressor station air quality permits, but FERC and do this on its own.

DEP defines an environmental justice area as "any census tract where 20 percent or more individuals live in poverty, and/or 30 percent or more of the population is minority". (See:

). There are supposed to be enhanced public participation requirements for permits in environmental justice areas, but news of this actually ever happening is scarce. In Fayette County, the entirety of Springhill, Nicholson, German, and Georges Townships are environmental justice areas, as well as a large part of Dunbar Township. Erosion & Sedimentation permit records do not currently include latitude and longitude. Where I am publishing latitude and longitude with E&S permits it is by inferring an associated well permit and using published latitude and longitude for the well. It is possible I may be inferring the wrong well site.

Municipalities are shown from eFACTS records on the DEP web site. The DEP has been known to list a municipality incorrectly.
